New clarification added: Most pump equipment requires commissioning and start-up works to be carried out by an authorized or specialized service center in order to ensure proper operation of the equipment and maintain the manufacturer's warranty.Could you please clarify whether the cost of commissioning, start-up and adjustment works, including the involvement of an authorized/specialized service center where required by the manufacturer, should be included in the quoted price of the pump equipment?If these services are required as a condition for maintaining the manufacturer's warranty, we kindly ask you to clarify whether bidders should include all associated costs in their financial offers.This clarification is important to ensure that all bidders calculate their offers on the same basis and that the total cost of the equipment, including mandatory commissioning services, is properly reflected in the tender evaluation.__CLARIFICATION RESPONSE__Dear Bidder,Thank you for your clarification request.If the Manufacturer’s warranty terms require commissioning works to be performed exclusively by the Manufacturer and/or its authorized representatives as a condition for the warranty to become effective or remain valid, such works shall be mandatorily included in the Bidder’s proposal.Accordingly, the Technical Specification of the RFQ will be supplemented with Requirement 2.5:2.5 If the Manufacturer’s warranty terms require commissioning, installation supervision, start-up, adjustment or any other works related to the Goods to be performed exclusively by the Manufacturer and/or its authorized service provider as a condition for the warranty to become effective or remain valid, such works shall be included in the scope of supply. The Supplier shall ensure compliance with all relevant Manufacturer’s requirements necessary for the warranty to become effective and remain valid. New clarification added: In connection with our review of the technical requirements specified in the tender documentation, we kindly request clarification and, where possible, consideration of the proposed amendments to the technical specifications of the pumping equipment.In order to broaden competition, attract a greater number of potential bidders, including European manufacturers, and ensure the possibility of offering technically equivalent or superior equipment, we kindly ask you to consider the following points:1. Maximum operating temperature of the liquid - Positions 1, 2 and 5According to the tender documentation, the maximum liquid temperature for the above-mentioned positions is specified as 110 °C.We kindly ask you to clarify whether a maximum liquid temperature of 110 °C is actually required for the pumps under Positions 1, 2 and 5.Based on practical experience with similar systems, the operating temperature of the liquid in most cases does not exceed 70–90 °C. At the same time, the requirement to operate at temperatures of up to 110 °C may have a significant impact on the design of the pumps, their cost and manufacturing lead times.If it is confirmed that the actual maximum liquid temperature does not exceed 100 °C, we kindly ask you to consider adjusting the relevant technical requirement accordingly. This would allow a wider range of potential manufacturers to participate and could also contribute to reducing the cost and manufacturing time of the equipment.This requirement is specified, in particular, in Sections 1.2.2.7, 1.3.1.4, 1.3.2.7, 1.6.1.4 and 1.6.3.4 of the tender documentation.__CLARIFICATION RESPONSE__Dear Bidder,Thank you for your clarification request.The request to reduce the maximum operating temperature of the pumped liquid is rejected. The technical requirements of the tender documentation regarding the temperature parameters of the pumping equipment (Items 1, 2 and 5) remain unchanged.Justification:The technical characteristics of the pumping equipment specified in the tender documentation are based on the initial design data of the construction/reconstruction project, namely an 80 MW boiler house. This heat supply source operates according to a high-temperature schedule, which is standard for large district heating systems:Primary boiler circuit: 130 °C / 80 °C (supply/return);Secondary circuit (district heating network): 115 °C / 70 °C (supply/return).Reducing the maximum operating temperature of the pumps would create a risk of an emergency situation and equipment failure during peak periods of the heating season.Technical justification by Item:Item 1 (Boiler Circulation Pumps):These pumps provide circulation directly through the hot-water boiler of the primary circuit. According to the design, the heat-transfer fluid temperature at the boiler outlet reaches 130 °C. The tender documentation requirement for a maximum temperature of +110 °C (as specified in the Item description) has already been minimized to the limit, taking into account the mixing of flows; therefore, any further reduction is not possible.Item 2 (Economizer Circulation Pumps):These pumps operate in the area of the highest thermal loads associated with cogeneration/waste heat recovery from the flue gases of the hot-water boiler, where the heat-transfer fluid temperature consistently exceeds 100 °C. A temperature capability of up to +110 °C is mandatory to prevent cavitation and damage to the mechanical seals.Item 5 (Double-Suction Network Pumps):These pumps provide circulation directly within the district heating network (secondary circuit), which is designed for a supply temperature of 115 °C. The tender documentation requirement for a maximum pumped liquid temperature of +120 °C for this Item is critically important, as it covers the network design maximum of 115 °C with a 5 °C technological safety margin.Reducing the requirements for the operating temperature range of the pumps would pose a direct threat to the reliable operation of the critical infrastructure facility (80 MW boiler house) and could result in a large-scale disruption of the city's heat supply during the winter period.With best regards, Procurement Team

New clarification added: Requirement pt. 2.3The warranty shall cover all defects in materials, workmanship and manufacturing. All direct and indirect costs associated with warranty service shall be borne by the Supplier.We kindly request the removal of the word "indirect" from the clause: "All direct and indirect costs associated with warranty service shall be borne by the Supplier."We propose the following amended wording: "All direct costs associated with warranty service shall be borne by the Supplier."Justification:Including "indirect costs" (such as potential lost profits of the enterprise, factory downtime, third-party utility disruptions, etc.) in the Supplier's obligations creates an undefined financial liability and opens the door to unfair or legally vague claims. These expenses are completely unrelated to the technical process of diagnosing, repairing, or replacing the pump itself.Standard international engineering practices and warranty policies of European manufacturers stipulate that the manufacturer/supplier is solely responsible for direct costs required to restore the equipment's functionality (parts, labor, and diagnostics). We request the removal of this phrase to ensure clear and legally fair contract terms.__CLARIFICATION RESPONSE__Dear Bidder,Thank you for your clarification request.Please note that the term “all direct and indirect costs associated with warranty service” in Clause 2.3 refers exclusively to costs associated with the performance of warranty obligations, including, where applicable, diagnostics, repair, replacement, transportation, removal/reinstallation of the Goods, and other activities related to warranty service.Provided that the Supplier duly performs its warranty obligations in accordance with the requirements of the Contract, this provision does not impose liability on the Supplier for loss of profit, loss of revenue, production downtime, or other indirect or commercial losses incurred by the end user.The requirement will be clarified accordingly in the Technical Specification:2.3 The warranty shall cover all defects in materials, workmanship and manufacturing. All costs directly associated with the performance of warranty obligations, including, but not limited to, where applicable, diagnostics, labour, spare parts, repair, replacement, transportation, removal and reinstallation of the Goods, shall be borne by the Supplier. New clarification added: Requirement 2.2During the warranty period, the Supplier or its authorized service center shall provide maintenance and repair of the Goods no later than thirty (30) calendar days from the date of receipt of a written or electronic notification from the authorized party.In the event that the Goods require replacement, the replacement period shall not exceed the delivery period specified in the Purchase Order.We kindly request to amend the clause regarding the replacement of Goods by adding the phrase "or its parts" to read as follows:"In the event that the Goods or any parts thereof require replacement, the replacement period shall not exceed..."Justification:A pump unit is a complex piece of engineering equipment consisting of distinct functional modules (such as the electric motor, hydraulic volute casing, impeller, mechanical seals, or electronic control units). This approach significantly speeds up the restoration of the pump's operability on-site and aligns with standard international service practices of European manufacturers__CLARIFICATION RESPONSE__Dear Bidder,Thank you for your clarification request.This requirement remains unchanged.Justification:The subject of this procurement is a complete, ready-for-operation pump unit as a single, integrated item of equipment (Goods) for the needs of the boiler house. Since the boiler house is a critical infrastructure facility ensuring uninterrupted heat supply, the warranty obligations and technical requirements specified in the tender documentation apply to the Goods as a whole.The term “Goods” by default encompasses all constituent parts, assemblies and components thereof. Further detailing of the tender documentation by adding the words “or parts thereof” is not considered necessary, as the existing wording fully and unambiguously protects the Recipient’s interests in receiving fully operational equipment with factory-level reliability in the event of a warranty claim.At the same time, the requirements of the RFQ do not restrict the Supplier in choosing the technical method for rectifying defects (including replacement of individual assemblies during maintenance or repair), provided that such measures restore the equipment to full operability within the specified 30-day period.With best regards, Procurement Team

New clarification added: Requirement 2.1Warranty period (minimum): thirty-six (36) months from the date of delivery of the Goods or twenty-four (24) months from the date of first operational start, whichever period expires later.We kindly request the amendment of the clause: "Warranty period (minimum): thirty-six (36) months from the date of delivery of the Goods or twenty-four (24) months from the date of first operational start..."Justification:The standard commercial warranty period provided by major European pump manufacturers (including DAB Pumps, Wilo, Grundfos, etc.) is 24 (twenty-four) months from the date of delivery or purchase.Demanding an extended warranty of up to 36 months, combined with an open-ended "whichever expires later" condition, does not align with standard factory warranties for serial industrial equipment. This requirement artificially restricts competition, as it obligates bidders to include third-party insurance or take on excessive financial risks, which unnecessarily increases the final tender price.We propose to amend this requirement to match the market standard: 24 (twenty-four) months from the date of delivery or purchase, which fully ensures the protection of the customer's interests based on official manufacturer backing.__CLARIFICATION RESPONSE__Dear Bidder,Thank you for your clarification request.These requirements remain unchanged.Justification:1. Protection of the boiler house buildingThe Equipment will be installed inside a building. Continuous operation of high-capacity pumps without adequate vibration protection would result in the transmission of dynamic and acoustic energy to the walls and floor structures, which is unacceptable under infrastructure reliability standards.2. Clarification of the requirementThe requirement does not stipulate that the vibration-isolation elements must be integrated into the pump design directly at the pump Manufacturer’s factory. The Bidder is fully entitled to offer a standard European pump in its standard factory configuration.3. Scope of supplyVibration-isolation elements (pads, vibration dampers) compatible with the support brackets may be manufactured by a certified third-party manufacturer. The Bidder shall supplement the support structure with such elements and include them in the overall scope of supply under this procurement.Therefore, the requirement does not create artificial restrictions for pump manufacturers, but merely establishes engineering safety requirements for the completed facility. The marking shall ensure unambiguous product identification and shall include at least:- manufacturer name or trademark;- flange type;- nominal diameter (DN);- nominal pressure (PN);- material grade/designation;- heat number or other material traceability identification;- country of origin (where required);- other information required by the applicable flange standard.We kindly request the removal of this entire clause due to its non-applicability to the requested equipment type.Justification:In modern single-stage In-line or close-coupled pumps the connection flanges are not separate components. They are cast as an integral, non-separable part of the main pump volute casing (hydraulic body).Therefore, there is no separate "flange manufacturer" or separate flange material characteristics apart from the pump casing itself. The origin, chemical composition, and characteristics of the casing material (e.g., cataphoretic cast iron or stainless steel) are already fully certified by the pump manufacturer's standard technical passports and test reports. Requiring distinct traceability and separate material documentation specifically for the flanges is technically incorrect for this type of equipment and artificially restricts competition. Status and criticality of the facilityThe Equipment covered by this procurement is intended for a large infrastructure boiler house classified as a critical infrastructure facility. Any technical failure or accident at such a facility poses a direct threat to the provision of essential services to the population and to regional safety. Accordingly, the RFQ includes enhanced requirements for reliability, metallurgical integrity and the quality of structural materials.2. Compliance with European and national legislationIn accordance with Directive 2014/68/EU (Pressure Equipment Directive), in particular Annex I, Section 3.1.5, and Clause 39 of Annex 1 to the Technical Regulation on Pressure Equipment (Resolution of the Cabinet of Ministers of Ukraine No. 27), the equipment Manufacturer is required to ensure full traceability of materials for all pressure-bearing components in order to prevent their mixing or substitution during manufacturing.According to the official guidance on the Directive (PED Guideline G-05), main body flanges are classified as main pressure-bearing parts. The fact that the flanges are cast integrally with the pump casing (In-line or close-coupled design) does not exempt the Manufacturer from compliance with this requirement. On the contrary, this means that the procedures for traceability, identification of chemical composition and marking shall apply to the entire hydraulic casing casting (including its flange areas) and shall be supported by the relevant quality documentation (in accordance with EN 10204, Type 3.1 or 3.2).3. Marking requirements to ensure traceabilityTo demonstrate compliance with the traceability requirements, the pump casing itself (including the area of the integral flanges) shall bear factory-applied marking (cast-in or applied by stamping/engraving). Such marking shall clearly identify: the material grade or material code; the Heat Number or a unique serial number of the component/casting batch that directly links the casting to the Manufacturer’s material quality certificate (in accordance with EN 10204).The RFQ requirement is fully consistent with fundamental international safety standards for industrial equipment and is critically important for facilities of this scale. Safety of the completed facilityOperation of the industrial boiler house at the maximum specified heat-transfer medium temperatures requires strict compliance with the EN 1514 series of standards regarding the type, dimensions and materials of gaskets. This is necessary to minimize the risk of loss of tightness and accidental leakage at flanged joints.2. Clarification of the requirementThe RFQ does not require external flange gaskets to be manufactured directly by the Manufacturer of the offered equipment (pumps) or to be specified in the individual technical data sheets of the pump units.3. Source of documentationThe term “Manufacturer’s documentation” means an official technical data sheet, quality certificate or test report issued by the actual manufacturer of the sealing materials/gaskets that the Bidder intends to supply for installation of the equipment.The Bidder may offer a standard European pump in its basic factory configuration. Scope of warranty coverageThe scope of warranty obligations is usually defined by the manufacturer's standard warranty policy and may vary depending on operating conditions, maintenance practices, installation quality, compliance with operating instructions, and other factors. Therefore, project-specific warranty statements containing exhaustive descriptions of all warranty obligations are not commonly issued by manufacturers.2. Maximum response time for repair and/or replacementDuring the current period of martial law in Ukraine, response times may be affected by circumstances beyond the control of the manufacturer, distributor, service partner, logistics providers or repair organizations, including transportation restrictions, security conditions, availability of spare parts, import procedures, and force majeure events.For this reason, manufacturers are generally unable to provide guaranteed maximum response times applicable to all possible situations throughout the warranty period. We therefore request that this requirement be replaced with a commitment to provide warranty support within a reasonable period according to the manufacturer's standard service procedures and subject to actual operating conditions.3. We kindly request a review of requirement 6.4 concerning the mandatory submission of documentation confirming the minimum rated bearing life (L10h).The requested confirmation requires identification of the exact bearing type/model installed in the offered equipment and preparation or endorsement of an L10h calculation by the bearing manufacturer or its authorized representative.However, for many internationally recognized pump manufacturers, including leading manufacturers of process and water pumps, information regarding the exact bearing type/model installed in a particular pump configuration is not disclosed in publicly available documentation and is often treated as proprietary information.
