New clarification added: Esteemed Bidders,Please review the following clarification:Question 11: The chassis specification for Refrigerated Vaccine & Medicine Transport Vehicles (RVTV) and Mobile X-Ray and Diagnostic Clinics appears to be based on a Toyota Landcruiser Hardtop and Landcruiser Pickup. Please confirm, or advise whether the client has a specific brand/model preference for the vehicle and other equipment.Advise whether alternatives based on Toyota Hilux or other chassis brand/models, equivalent products, or deviations from the tender requirements are acceptable.Answer: There is no preferred brand or model. Any brand or model that meets or exceeds the minimum technical requirements specified in Form D (Technical Bid Form) will be evaluated and considered equally compliant. Equivalent products or alternative chassis that meet all specified functional and performance parameters are acceptable.Question 12: As stated in the tender under Section II: Schedule of Requirements, Bidders may, at their own discretion, submit offers for any individual lot, a combination of lots, or all lots. If we are unable to obtain quotations for all products, we intend to submit an offer only for the products for which quotations are available. Please confirm.Answer: Confirmed. Bidders are required to commit to this delivery timeframe in their bids.Question 14: The tender states that ‘The language of the training will be the official language of the destination’. We can provide training in the major available languages, including English and Arabic. The availability of other languages will be discussed at the time of vehicle delivery and will be subject to availability.Answered: The specific language of instructions/training, as well as any necessary translation support, will be formally specified at the call-off/order placement stage based on the destination country. Question 15: If available, provide any preferred layouts, reference drawings, or functional workflow requirements for each lot.Answer: No reference layouts or drawings are provided beyond the minimum specifications set forth in Section II (Schedule of Requirements) and Form D. New clarification added: Esteemed Bidders,Please review the following clarification:Question 5: Since demand for RHD is not quite high, will you accept to treat RHD as non-mandatory option?Answer: Many of the destination countries for these vehicles have left hand traffic, therefore RHD is a mandatory option.Question 6:  Will you kindly accept that RHD to be 2WD instead of 4WD?Answer: Vehicles under lots 1, 2 and 3 are required for heavy-duty off-road operating conditions; therefore, 4WD is a minimum requirement.Question 7: We kindly request clarification regarding the following bidder qualification requirement:"Bidder should be in continuous business of manufacturing/supplying products similar to those specified in Section II: Schedule of Requirements for at least the last five (5) years prior to bid opening. Bidder must provide copies of at least five (5) Purchase Orders/Contracts awarded and completed/executed, with at least one against each year, in addition to the duly completed Form H: Bidder Experience Form."We would appreciate your confirmation on the interpretation of the requirement "at least one against each year."Specifically, could you please clarify whether:The Bidder is required to submit at least one completed Purchase Order/Contract for each individual year within the last five (5) years (i.e., one reference from each year); or It is sufficient to submit a minimum of five (5) completed Purchase Orders/Contracts issued at any time during the last five (5) years, regardless of their distribution across the individual years, provided that they all fall within the required five-year period.Answer: To demonstrate continuous business operations over the past five (5) years, the Bidder must submit at least one (1) completed Purchase Order/Contract for each individual year within the 5-year period prior to bid opening (i.e., a minimum of 1 reference per calendar year across all 5 years). New clarification added: Esteemed Bidders,Please review the following clarification:Question 1: Whether a two week extension could be considered given the summer period during which holidays are taken meaning that the resources needed to put a bid together becomes more challenging during the months of July and August.Answer: At this time, an extension of the deadline is not being considered.Question 2: Whether currency Japanese Yen could also be accepted alongside US Dollar and Euro. Answer: Japanese Yen (JPY) is an acceptable bidding currency alongside the US Dollar and Euro. A formal amendment to the tender documents will be published shortly to reflect this update.Question 3: Our refrigerator product is based on a single cabin platform that is not WHO PQS qualified but is qualified to Goods Distribution Standard. In light of this, should our company bid for lot 1 or lot 2?Answer:The minimum technical requirements for Lots 1 and 2 are identical, with the sole exception of Requirement 9.4 under Lot 1. Lot 1 strictly requires the refrigerated device and its monitoring systems to be prequalified under the WHO Performance, Quality and Safety (PQS) process. Bidders whose products are not WHO PQS qualified must bid under Lot 2, as a non-WHO PQS product offered under Lot 1 will be deemed technically non-compliant.Question 4: We would be grateful if you could kindly provide a clarification regarding the requirement for Contractors to accept and fulfil Purchase Orders issued by UNOPS offices worldwide.As a supplier, we are committed to full compliance with all applicable local, regional, United Nations, and any other relevant sanctions and export control regulations. In addition, our internal compliance policies do not permit us to engage in transactions involving sanctioned or otherwise restricted parties, prohibited destinations, or transactions that cannot be carried out in accordance with applicable laws and our corporate compliance standards.In this regard, we would be most grateful if you could kindly confirm whether, in the event of contract award, the Contractor may decline, suspend, or discuss an alternative arrangement for a Purchase Order where the consignee, end user, payment bank, transport route, or delivery destination is subject to sanctions, export control restrictions, or other legal, banking, insurance, logistics, or security limitations beyond the Contractor's reasonable control.Furthermore, we would highly appreciate your confirmation as to whether such a compliance-based limitation may be reflected in the Long-Term Agreement and whether its inclusion would be considered acceptable and would not constitute a material deviation from the tender requirements.Answer:UNOPS recognizes that multinational suppliers must adhere to the legally binding export controls and sanctions of their respective governing jurisdictions. We can confirm that the standard contractual framework provides the necessary protections for these circumstances without requiring custom amendments to the LTA template.In the event of a contract award, your compliance-based limitations are covered by the following standard provisions:Each PO is a Separate Contract (LTA Clause 1.8): The standard UNOPS LTA stipulates that “Each Purchase Order shall be deemed to be a separate contract between the Parties.” Consequently, if a specific delivery destination or consignee poses an insurmountable legal or regulatory conflict, addressing or declining that specific Purchase Order does not automatically place your organization in breach of the overarching LTA framework.Compliance with Laws (GCC, art. 26, Observance of the Law): The UNOPS General Conditions of Contract (GCC)—which govern all issued Purchase Orders per LTA Clause 1.7.1—explicitly state: “The Contractor shall comply with all laws, ordinances, rules, and regulations bearing upon the performance of its obligations under the Contract.” This obligates the Contractor to adhere to their applicable national export control and sanctions laws.Mechanism for Alternative Arrangements (GCC, art. 13, Force Majeure; Other Changes in Conditions): If a specific Purchase Order involves a prohibited destination, restricted party, or banking limitation beyond the Contractor's reasonable control, the GCC provides a clear mechanism. The Contractor must promptly notify UNOPS of “any other changes in conditions or the occurrence of any event that interferes or threatens to interfere with its performance of the Contract.” Upon such notification, both parties can practically discuss alternative arrangements or the suspension/cancellation of that specific PO.Finally, while LTA Article 1.4 notes that the Contractor must accept and honour Purchase Orders globally, products must be fully compliant for the destination country's (e.g., homologation, warranty, after-sales services) to be validly executed under the LTA.Kind regards,
