New clarification added: Dear bidders,We have received the following request for clarification:QUESTION:1. Additional Insured RequirementThe draft contract requires the Contractor to:"6.5.1 name UNOPS as an additional insured under the liability policies, including, if required, as a separate endorsement under the policy."Please note that we are unable to name clients or contracting authorities as additional insureds under our liability insurance policies or provide separate endorsements for this purpose.We therefore request confirmation that compliance with the insurance requirements may be demonstrated through maintenance of the required liability coverage without the obligation to add UNOPS as an additional insured. 2. Limitation of LiabilityThe draft contract further states that:"6.8 The Contractor acknowledges and agrees that neither the requirement for taking out and maintaining insurance as set forth in the Contract nor the amount of any such insurance, including, but not limited to, any deductible or retention relating thereto, shall in any way be construed as limiting the Contractor’s liability arising under or relating to the Contract."Our standard contracting practice requires that liability under the contract be capped. Accordingly, we would request that the parties agree to a limitation of liability equal to the total contract value. We would appreciate confirmation as to whether UNOPS would be willing to amend the contract accordingly or propose alternative wording acceptable to both parties.Clarification:The references made within the request relate to the different type of contract (Contract for provision of services) while for the services in this tender the following terms apply: CONSULTANT SERVICES CONTRACT FOR WORKS (published within the tender documentation "7 Consultant Services Contract for Works_ template") and its unique GENERAL CONDITIONS OF CONTRACT.
