New clarification added: Question: We refer to the Request for Proposals for the above-mentioned consultancy assignment and appreciate the opportunity to participate in this procurement process.Having reviewed the eligibility requirements stipulated in the solicitation document Under “SECTION II: EVALUATION METHOD AND CRITERIA, 2. QUALIFICATION CRITERIA” item no. 5, we seek clarification regarding the mandatory requirement for firms to provide certification of registration under the Engineers Registration Board (ERB) Uganda – Civil Category and Uganda Association of Consulting Engineers (UACE) – Class A.Our understanding of the applicable public procurement framework in Uganda is that the primary eligibility requirements for participation in public procurement processes generally include, among others:Certificate of Incorporation/Registration issued by the Uganda Registration Services Bureau (URSB);Registration as a provider with the Public Procurement and Disposal of Public Assets Authority (PPDA), where applicable;Valid Trading License;Valid Tax Clearance Certificate;Evidence of compliance with National Social Security Fund (NSSF) obligations; andOther statutory requirements as may be prescribed by the procuring entity. We respectfully note that registration of consulting firms with the Engineers Registration Board (ERB) is not a mandatory statutory requirement for eligibility to participate in public procurement processes in Uganda. Consequently, our firm, Segamu 14 Consults Ltd, is not registered with the ERB, although we fully comply with all mandatory statutory and regulatory requirements governing the operation of consulting firms in Uganda.Similarly, while our firm is currently registered as an Associate Member of the Uganda Association of Consulting Engineers (UACE), we understand that UACE membership is generally regarded as a professional affiliation that may provide added value and demonstrate industry engagement but is not ordinarily a mandatory eligibility requirement for participation in government procurement processes.We further note that professional registration requirements are typically applicable to individual experts proposed under the assignment rather than to the consulting firm itself. The offeror has the required registration in the bodies that governs and regulates the engineering consulting industry in Uganda" While if the Consultant is registered in other contry out of Uganda, Could you kindly clarify whether a consulting firm that is duly registered and licensed in a country other than Uganda, but is not currently registered with the relevant Ugandan regulatory bodies, is eligible to participate in the bid?
