New clarification added: 1. Section Q2 states that the bidder must have been continuously engaged in the supply of the proposed or equivalent equipment for at least the last 3 years. Please clarify what the procurement organizer means by continuous supply. For example, if a manufacturer has been supplying both GHS and boiler rooms for the last three years, will this be considered continuous supply, or should only GHS be included in the manufacturer’s range for the last 3 years? Please also clarify what is meant by equivalent equipment.2. Section Q8.2 states that the bidder must provide certificates of compliance with Ukrainian technical requirements (for each product) with the tender proposal. In accordance with Part Two of Article 23 of the Law of Ukraine “On Standardization”, national standards are applied on a voluntary basis, except in cases where their application is mandatory established by regulatory legal acts.In addition, according to the Law of Ukraine “On Technical Regulations and Conformity Assessment”, legal regulation in the field of product conformity confirmation is carried out through technical regulations and the conformity assessment procedures provided for by them, and voluntary conformity assessment is also allowed. That is, the obligation to obtain a certificate is possible only if this is directly provided for by the legislation for the relevant type of product.Additionally, we note that in Ukraine the former List of products subject to mandatory certification has lost its validity based on the order of the Ministry of Economic Development of Ukraine dated 01/26/2018 No. 93; the relevant order approving such a List contains a direct note on the loss of validity. Therefore, the requirement for mandatory certification cannot be considered general for all products without a direct norm of special legislation or technical regulations. In view of the above, we ask you to review the procurement conditions and remove this condition (as discriminatory?).Dear BidderThank you for your request. Please find the answers below. The requirements “Bidder must be in continuous business of supplying of the offered or equivalent equipment for at least past 3 years” means that the Bidder is in business (registered) for at least 3 full years and has experience (proven previous experience) in supplying offered (identical to the ones required under this RFQ) or equivalent (gas cabinets of various configuration and capacity) goods during past 3 years. This requirement means that the Bidder must provide evidence that the goods are compliant with Ukrainian technical standards and are allowed to be used in Ukraine. The requirement is mandatory and can not be changed.Thank you.

According to the parameters of the pressure gauges that are installed after the regulator, namely DM 05-100 (M)-1.0-0-60 kPa - 1 pc, gas cabinets should have an output medium pressure, but the markings of some regulators have the BP mark (FES BP. FEXS L 100 BP, FEX L 75 BP, DIVAL 500G BP), which indicates either the need to replace the pressure gauge range, or an error in the labeling of the regulators. Please provide an answer and, if necessary, make changes.Dear BidderThank you for your request. Please find the answer below. We clarify that, for Lot 1 gas cabinets, the maximum operating pressure downstream of the regulator shall be 10 kPa.In this regard, the use of pressure gauges downstream of the regulator with a lower pressure measuring range than the one specified in the technical requirements is allowed, provided that such range ensures proper control of the outlet pressure and complies with the requirements for safe operation of the equipment. The BP designation in the specified pressure regulator models is not an error and corresponds to the required operating parameters of the regulators for this application. The Bidder shall propose a pressure regulator in the appropriate configuration ensuring a maximum operating pressure downstream of the regulator of 10 kPa, and shall confirm compliance of the proposed equipment by submitting the manufacturer’s technical documentation, passport, catalogue, or another supporting document.Thank you.
