Description
The United Nations Office for Project Services (hereinafter "UNOPS") invites you to submit documents for prequalification for the Provision of Engineering Services in Ukraine.
This Pre-qualification is a formal method of assessing an organisation against a set of pre-determined criteria. This process is not related to specific solicitation process and focuses on a general assessment of an organisations’ operational, personnel capabilities and internal processes, including internal quality management and financial health.
Please refer to the attached Section I Instructions to Prospective Bidders for details.
IMPORTANT NOTE: Interested vendors must respond to this tender using the UNOPS eSourcing system, via the UNGM portal. In order to access the full UNOPS tender details, request clarifications on the tender, and submit a vendor response to a tender using the system, vendors need to be registered as a UNOPS vendor at the UNGM portal and be logged into UNGM. Clarification meeting

Participation in the clarification meeting is not mandatory but participation is strongly encouraged to avoid the risk of non-compliant bids. Depending on the interest UNOPS reserves the right to change the modality of the meeting. All interested Bidders will be timely informed about the meeting details.

In case of JV arrangement, at least one of the JV members must be a registered legal entity duly authorized to perform engineering design/construction supervision services in Ukraine. Any or all of JV/Consortium partners must employ (or engage in any contractual form) the required certified specialist/s.These requirements apply to the bidders as of the day of their submissions." Unfortunately, we identified this opportunity only a few days ago.As this represents our first participation in a UNOPS prequalification process, and considering the complexity of the requirements, in particular the need to identify and formalize collaboration with qualified local Ukrainian partner as per eligibility and regulatory conditions, we kindly request a reasonable extension of the submission deadline to allow adequate time to ensure compliance with the requirements. New clarification added: Dear UNOPS Procurement Team, With reference to Schedule 7 (Declaration), which requires the signature, name, occupation, and address of an authorised witness, we kindly request your clarification on this requirement. Could you please advise whether there are any specific criteria for such a witness and how a person can be considered an “authorised witness” in this context? ________ Dear Bidder, Thank you for the inquiry. New clarification added: Dear UNOPS Procurement Team,With reference to the project description, it is stated that the scope includes the “rehabilitation and construction of healthcare, social, educational, residential, industrial and engineering infrastructure facilities.”At the same time, the experience requirements refer to “construction supervision of building construction.”We would kindly request your clarification as to whether the term “building construction,” for the purposes of the experience requirements, also includes reconstruction works, as well as rehabilitation and major repair works.In this regard, could a Bidder demonstrate the required experience by submitting contracts for technical supervision services related to the reconstruction and/or major repair of facilities?In addition, this and other questions were raised during yesterday’s meeting. Accordingly, Bidders may demonstrate the required experience by submitting contracts for design and/or construction works supervision services related to any of the above categories of works. Bidders are further advised that, during the evaluation process, UNOPS will consider the relevance, complexity, and scale of the submitted assignments, including factors such as the nature of the works, project value, duration, and overall scope of services provided, in determining the extent to which the experience demonstrates the Bidder’s capacity to perform the contemplated services. New clarification added: Dear Procurement Committee,Regarding the professional certification requirements for Key Experts (consequence classes CC2 and CC3), we kindly request clarification on the following: 1) Will international professional certifications be accepted as equivalent to Ukrainian state certificates (CC2/CC3) for the purpose of evaluating the experts' qualifications at the Pre-qualification (PQ) stage? 2) Considering that Ukrainian legislation requires local CC2/CC3 certification for signing and approving project documentation, is it permissible to substitute an international expert (proposed at the PQ) with a Ukrainian-certified specialist at the project implementation stage to ensure legal compliance? 3) Will such a substitution, necessitated by national statutory requirements, be considered an accepted procedural adjustment rather than a reason for qualification scoring reduction, provided the replacement expert meets all other technical criteria? ________ Dear Bidder, Thank you for the questions. EVALUATION CRITERIA,4.1. - Preliminary Evaluation Criteria - (APPLIES FOR BOTH LOTS) it is stated that: The Bidder and each member of Joint Venture must be a registered legal entity, duly authorized to perform engineering design/construction supervision services in Ukraine.Meanwhile, in your clarification, you stated:“International companies may participate in the tender provided they engage certified Ukrainian sub-contractors OR have such certified specialists on their staff lists OR by means of a Joint Venture/Consortium.”In this regard, could you please clarify whether an international company may participate in a consortium (JV) with a Ukrainian company that holds the required licence, or whether each member of the consortium is required to be individually duly authorized to perform engineering design and construction supervision services in Ukraine?Best Regards__________ Dear Bidder, Thank you for your request. In case an international (foreign) company decides to participate in this Pre-qualification in JV/Consortium:The Bidder and each member of Joint Venture must be a registered legal entity, duly authorized to perform services in respective country. In case of international JV arrangement, at least one of the JV members must be a registered legal entity duly authorized to perform engineering design/construction supervision services in Ukraine. New clarification added: Dear Sir/Madam;Our company is a construction company headquartered in Ankara, Türkiye, with branches in several countries. The company is actively involved in United Nations projects and has extensive experience working on projects financed by international organizations such as North Atlantic Treaty Organization and United States Army Corps of Engineers.After reviewing the tender documents, we understand that holding a Ukrainian license is a mandatory requirement in order to participate in the prequalification process.We would appreciate your consideration in removing this requirement in order to enhance international competition and encourage broader participation from qualified international contractors. Or, We kindly request that this requirement be amended so that the Ukrainian license may be obtained during or after the tender process.Regards. _________ Dear Bidder, Thank you for your request. Ukrainian legislation prescribes the participation of certified specialists in design, author supervision, and technical supervision activities. Therefore, removing the relevant requirement(s) is not possible. According to Ukrainian law, engineering services - specifically design and technical supervision - are not merely corporate activities but a sphere of personal professional responsibility. Any design documentation or certificates of completion are considered legally valid only if they bear the signature and seal of a specialist holding a valid Ukrainian state qualification certificate. Furthermore, the entire regulatory process, from project registration to final commissioning, is managed through the E-Construction System (EDESSB): https://e-construction.gov.ua/. Access to this digital system is restricted exclusively to certified specialists holding registered Ukrainian electronic signatures. Therefore, removing this requirement would make the legal oversight of construction and the official commissioning of the facility impossible. International companies may participate in the tender provided they engage certified Ukrainian sub-contractors OR have such certified specialists on their stafflists OR by means of a Joint Ventrure/Consortium. PQ/2026/62587), but we noticed that the Terms of Reference (TOR) does not appear to be included in the documents on UNGM. Could you kindly share the TOR at your earliest convenience, or let us know if it is located elsewhere? Thank you. ___________ Dear Bidder, Thank you for your question. The generic description of services (Lot 1 and Lot 2) is provided in the Section_II_Evaluation method and criteria_PQ_2026_62587.pdf document. As described in the referenced document (par. 1 - Pre-qualification details): "All firms pre-qualified by UNOPS to deliver the specific service shall receive in due course a tender invitation for provision of design, engineering and construction supervision services. In each instance, a Request for Quotation or an Invitation to Bid shall be issued to give you the opportunity to submit your technical and financial proposals. Given the wartime conditions in Ukraine, obtaining Apostilles and external certified translations for the required volume of documents is logistically impossible within the current timeframe.Will UNOPS accept documents verified by the company's official seal and the Director's signature instead of requiring Apostille/external certification?If not, we respectfully request a deadline extension, as the current timeline is insufficient to complete these legal procedures under present operational constraints.Sincerely,___________ Dear Bidder, Thank you for interest in the Pre-qualification.
