Statutory Registration Requirements (PNG)We seek clarification from UNOPS regarding compliance with Papua New Guinea statutory requirements for the provision of engineering and architectural services under this assignment.Specifically, we note that the scope of services includes inspection and assessment activities that may fall within the definition of professional engineering and architectural services under the Engineers Act 2000 (as amended) and the Architects Act 1989 (as amended) of Papua New Guinea.Under these Acts, it is our understanding that:· Individuals undertaking professional engineering services are required to be registered with the Institution of Engineers Papua New Guinea (IEPNG); and· Individuals undertaking architectural services are required to be registered with the PNG Board of Architects.We further note that the legislation provides for penalties where unregistered persons undertake or represent themselves as undertaking such professional services, including fines and/or other enforcement actions under the respective Acts.In this context, could UNOPS please confirm:· Whether compliance with the above statutory registration requirements is mandatory for all proposed personnel undertaking engineering and/or architectural inspection services under this assignment; and· Whether such compliance will form part of the evaluation criteria or contractual obligations.We highlight that confirmation of this requirement has material implications for team structuring, mobilisation, and associated costs, and we therefore seek UNOPS’ guidance to ensure our submission is fully compliant with both local legislation and UNOPS expectations.2. Kindly confirm if we need to allocate a different team for each lot for office-based personnel and field-based personnel. Also confirm if we are not allowed to repeat the team in any of the 3 lots.Warm RegardsANSWER :1. The scope of the project is the rehabilitation of the existing building which does not require extension of the existing building or reconstruction. Therefore,, inline with this scope of Works the required provision of Government will apply.2. The bidder could propose to allocate the same or different team for each-lot as the contract award to a bidder is limited to one.

New clarification added: QUESTIONDear UNOPS Procurement Team,We kindly request clarification on whether a bidder may include the same proposed field teams personnel in proposals submitted for more than one lot, where the solicitation provides that each successful bidder will be awarded only one lot.Specifically, if a bidder submits proposals for multiple lots on the understanding that only one lot may ultimately be awarded to that bidder, would UNOPS permit the bidder to nominate the same field teams personnel across those multiple lot submissions?We would appreciate your clarification on this matter to ensure compliance with the proposal submission requirements.Kind regards,ANSWER Yes it is possible to propose the same field teams for multiple lots, noting that one bidder can only be awarded 1 lot. New clarification added: QUESTIONDear UNOPS Procurement Team,Further to our previous query, we would also like to clarify whether the same personnel can be assigned to both office-based roles and field team positions, or if UNOPS expects these roles to be staffed by separate individuals.Thank you.ANSWER As per the Terms of Reference, the office-based team shall be separate from the field teams. This is necessary to ensure the timely preparation of reports and detailed engineering designs.

New clarification added: QUESTIONDear UNOPS Procurement Team,We would like to clarify the Key Personnel requirements under Schedule 4.4.For bidders applying to a single lot, is it mandatory to propose two fully staffed field teams at the proposal stage, or would it be acceptable to propose one team with the capacity to scale to two during implementation?Thank you for your guidance.ANSWERThe minimum requirement for the implementation of one (1) Lot is the mobilization of at least two (2) field teams. This requirement is based on the scope of services and the dispersed geographic locations of the health facilities.Proposals indicating only one (1) field team will not be considered compliant, as a minimum of two (2) field teams is required to ensure timely delivery of the assignment.Thank you

Can you confirm if per diems for field teams should be included in travel costs or in the lump sum fee? Thank youANSWER1. New clarification added: QUESTIONPhase 2 requires “Detailed Rehabilitation Engineering Design and Tender Document Preparation For the four (4) health facilities identified under each Lot based on the prioritisation and investment criteria established by the National Department of Health (NDOH), Provincial Health Authorities (PHAs) and other relevant stakeholders, the Consultant shall, subject to written instruction from UNOPS, proceed with the execution of a Condition Assessment and Structural Integrity Assessment. The purpose of this assessment is to determine the structural safety and technical feasibility of rehabilitation works and to provide the technical basis for identifying one (1) building per prioritised health facility to proceed to detailed rehabilitation engineering design. Based on the findings of the condition and structural integrity assessment, the Consultant shall propose the most suitable building within each prioritised facility for rehabilitation. The final selection of the building shall be confirmed by UNOPS, following review of the assessment findings and consultation with relevant stakeholders. The detailed rehabilitation engineering design shall support the implementation of rehabilitation works and shall include, but not be limited to,· MEP works - Upgrading or replacement of electrical wiring, distribution boards, lighting, water supply systems, sanitary fixtures, drainage systems, and ventilation components to ensure safety, reliability, and operational readiness. · Architectural rehabilitation - Refurbishment of internal and external finishes, roofing systems, ceilings, doors and windows, flooring, and repainting works, including improvements to functionality and compliance with current standards. · Static Plant and utility systems - Rehabilitation or upgrading of power supply systems, backup generators, solar installations where applicable, water storage tanks, and other supporting infrastructure essential for facility operations. Minor structural strengthening· Biomedical Equipment Readiness Interface - Ensuring that infrastructure rehabilitation supports the installation and safe operation of biomedical equipment, including adequate space planning, load requirements, grounding, and environmental conditions. · Health, Safety, and Code Compliance Upgrades - Integration of fire safety measures, accessibility improvements, infection prevention and control considerations, and alignment with applicable national codes and UNOPS standards. The Consultant shall prepare complete technical specifications, drawings, Bills of Quantities, detailed cost estimates and full tender documentation suitable for competitive procurement.Question – the extent of consultancy services to be provided to satisfy this requirement of Phase 2 can vary significantly depending on what building is selected by UNOPS. Is UNOPS willing to accept provisional sum pricing for this component or negotiated pricing to ensure that Value for Money is achieved?ANSWERUNOPS considers that the scope is not expected to vary materially in a manner that would result in significant cost implications. The selection of buildings will be limited to those assessed as structurally sound and suitable for rehabilitation.Accordingly, the selection criteria will include the level of service delivery, the condition of the building to accommodate rehabilitation works, and the potential impact on improving health service delivery.For preparing the financial proposal, bidders should consider Level 3 health facilities with 36 Beds and the selected building is Maternity and Inpatient Area/Ward. New clarification added: QUESTIONThe project has significant high-risk safeguarding and modern slavery considerations; should costs associated with safeguarding and modern slavery be incorporated into the Key Personnel nominated by UNOPS or should additional Key Personnel Positions be nominated by the tenderer?Section 3 Selection Criteria refers to “UNOPS intends to award a maximum of one (01) Lot per Bidder”. Later references in Schedule 2 Project Specific Information advises “Where a Consultant is awarded more than one lot”.Can you confirm that subject to the outcomes of the procurement process that one legal entity can or cannot be awarded more than one lot?To inform lump sum pricing of the Phase 2 activities can you confirm the following:That as-built documentation is available for all properties to be inspected.If as built documentation is not able to be provided by UNOPS, should all tenderers allow lump sum pricing to produce as built documentation as part of their lump sum phase 2 pricing? ANSWER1. The Bidder must ensure compliance with all applicable safeguarding requirements to deliver services safely and ethically.Including an HSSE Officer as Key Personnel is sufficient to address these requirements.Bidders may propose additional Key Personnel for safeguarding management; these will be subject to evaluation and approval by UNOPS2. 01 bidder will be awarded only 01 lot as a result of the evaluation.3. Phase 2 which is the detailed engineering design and tender document preparation of one building from selected health facilities will be conducted after the condition assessment and structural integrity. The facilities may/not have a built document. The bidder is not required to develop as built drawing to the facilities; but detailed rehabilitation engineering design is required incorporating architectural, electrical, mechanical and plumbing.

All insurances requirements are indicated in Section 3.10 Insurance Requirements of the Terms of Reference.For this tender we are asking for Professional Indemnity Insurance, Contractor’s All Risk Insurance, and Workers’ Compensation Insurance. At the time of the bid submission, bidders are only required to confirm their agreement to provide the insurance as required in the solicitation. In case of award the selected bidder should provide the copy of the insurance as per the contract condition.3. Any destructive tests that are proposed to be conducted should be reflected separately under Reimbursable Expenses indicated section 3.9 of the tender document. Schedule 0.2 [Offeror’s Information], 6. Schedule 0.3 [Joint Venture Partner Information], 7. Schedule 0.4 [Capacity and Experience], 8. Schedule 0.5 [Format for Resume of Proposed Key Personnel], 9. Schedule 0.7 [Performance Statement], 10. Schedule 4.4 [Key Personnel], 11. Schedule 4.5 [Organizational Structure], 12. Schedule 4.6 [Sub-consultants], 13. Schedule 4.7 [Consultant’s Equipment and Machinery] and 14. Schedule 4.8 [Insurance Details and Insurances]. However, we are trying to upload 4.2 - Programme and 4.3 - Method Statement but couldn't locate the space. Please confirm or we have to upload under one the above 14 space. ANSWERPlease note that the grouping of the file uploading is separated into 2:Documents uploaded at the main tender level Documents uploaded at the lot level. Document 4.2 Programme and 4.3 Method Statement are to be uploaded at the lot level.
