Please find below a summary of your question and the corresponding UNOPS response.Requested by: Masho Gebre Kirstos (nebyouliben@gmail.com)Question 1 – Annual Turnover RequirementIs the requested annual turnover amount inclusive of 15% VAT? In case the audited financial statements do not include VAT in the turnover figures, will UNOPS accept adding 15% VAT to the reported turnover in order to determine whether the requirement is satisfied?Response:The annual turnover requirement indicated in the solicitation refers to the actual revenue/turnover as reported in the bidder’s audited financial statements.In accordance with the financial capability assessment practices of United Nations Office for Project Services (UNOPS):The turnover will be verified based on the figures presented in the audited financial statements submitted by the bidder.Adjustments or additions such as VAT should not be applied to the turnover figures for the purpose of meeting the minimum turnover requirement.The evaluation will therefore rely strictly on the financial information reported in the audited accounts.Question 2 – Market Price Escalation and Contract ConditionsQuestion:Due to international market price escalation, market prices are becoming unpredictable. The effects are currently observed in reinforcement bar price increases and fuel shortages. Is there any support mechanism from UNOPS such as reducing bid validity days, allowing price adjustments, or any other options to address these risks?Response:Bidders are requested to submit their bids in accordance with the requirements and conditions specified in the Invitation to Bid (ITB).In line with the procurement procedures of United Nations Office for Project Services (UNOPS):The bid validity period remains as specified in the solicitation documents and cannot be modified during the clarification stage.Unless explicitly stated otherwise in the solicitation documents or the draft contract conditions, bids submitted under an ITB are expected to be based on firm and fixed prices.Any provisions related to price adjustment or escalation would only apply if they are clearly included in the solicitation or contract conditions.Bidders are therefore advised to carefully consider potential market fluctuations and supply risks when preparing their bids.

New clarification added: Date: 5 March 2026Dear Bidder,Thank you for your interest in the UNOPS tender and for submitting your request for clarification. Please find below a summary of your question and the corresponding UNOPS response.Question No. 1:The bidder is an international construction contractor registered in China that has a legally registered subsidiary in Ethiopia with independent legal person status and a valid local registration certificate. In this regard, we would appreciate confirmation on the following:If the parent company submits the bid in its own name, would it be acceptable to use the Ethiopian subsidiary’s local registration certificate and qualification documents to satisfy the tender requirement for local registration in Ethiopia?In such a case, may the project experience of the parent company be considered to meet the experience requirements specified in the tender (i.e., two contracts ≥ 115 million ETB each, or one contract ≥ 225 million ETB)?Answer No. 1:UNOPS evaluates the legal entity that submits the bid. The bidder must demonstrate that it meets the eligibility and qualification requirements specified in the solicitation documents. If the required documentation or eligibility criteria are not met by the bidding entity, the bid may be considered non-compliant.In the case described:The parent company is registered in China.The subsidiary is registered in Ethiopia and has independent legal person status.Since the subsidiary has independent legal status, it is considered a separate legal entity for procurement purposes.Accordingly, if the parent company submits the bid, it must itself meet the registration and eligibility requirements specified in the ITB. The local registration certificate of the Ethiopian subsidiary cannot be used to satisfy the local registration requirement if the subsidiary is not the bidding entity.Regarding the experience requirements, under the UNOPS Procurement Manual the evaluation of experience and capacity is based on the legal entity submitting the bid.
