New clarification added: Dear UNOPS Team,To ensure proper financial and regulatory compliance on our side as a Ukrainian-registered company, we kindly request clarification on the following:In the described humanitarian import model, where the beneficiary hospital acts as the humanitarian aid recipient and submits the customs declaration, while the awarded supplier arranges shipment under DAP conditions:May a Ukrainian-registered supplier act as the contractual counterparty to UNOPS and receive contractual payment, even though the goods are customs-cleared directly to the beneficiary hospital under the humanitarian aid regime?We seek confirmation to ensure correct structuring in accordance with Ukrainian banking and tax regulations./Dear Bidder, We confirm that a Ukrainian-registered supplier may act as the contractual counterparty to UNOPS and receive full contractual payment, even if the goods are customs-cleared directly to the beneficiary hospital as the registered recipient of humanitarian aid. This structure is fully compliant with Ukrainian legislation, including Law No. 1192-XIV and CMU Resolution No. 953, which designate the hospital (the Recipient) as the declarant responsible for registering the aid in the Automated System to trigger 0% VAT and duty exemptions (Art. 197.11 of the Tax Code). Under this model, the contractual relationship between UNOPS and the supplier remains distinct from the humanitarian transfer; UNOPS serves as the Payer/Buyer, while the supplier fulfills delivery under DAP terms, providing documentation marked as "Humanitarian Aid" to facilitate the hospital's clearance process.Thank you.Procurement team.

New clarification added: Dear UNOPS Team,To ensure full compliance with Ukrainian customs legislation under the humanitarian aid framework, kindly clarify the following:Who will act as the importer of record during customs clearance under the humanitarian aid regime — the awarded supplier or the beneficiary hospital registered in the Unified Register of Recipients of Humanitarian Aid?Will the customs declaration in accordance with Cabinet of Ministers Resolution No. 953 be submitted by (or on behalf of) the beneficiary hospital using its humanitarian aid registration code?Is it acceptable to apply the procedure under Cabinet of Ministers Resolution No. 174 dated 01.03.2022 for border crossing formalities, if applicable?Kindly confirm the intended operational flow of the project (contractual payment, import, customs clearance and delivery to the beneficiary) to ensure correct logistical and financial structuring on our side.Thank you in advance for your clarification./Dear Bidder,Thank you for you interest in the tender.Please find below the clarifications on your questions:1. Goods should be procured tax-free. Goods can be imported as humanitarian aid. The beneficiary hospital registered in the Unified Register of Humanitarian Aid Recipients will act as the humanitarian aid recipient, while the awarded supplier will arrange shipment and cooperate with the designated customs broker. UNOPS will coordinate the process with all parties.2. Customs declaration under CMU Resolution No. 953:Yes — the humanitarian aid declaration will be submitted by the beneficiary hospital via the Automated Humanitarian Aid Registration System, using its humanitarian aid registration code. 3. Application of CMU Resolution No. 174 (01.03.2022): Yes, simplified wartime border-crossing procedures may be used in accordance with Ukrainian legislation and customs guidance.4. UNOPS conducts procurement and contracts the supplier; the supplier prepares export documentation and shipment; the beneficiary hospital registers the humanitarian aid and submits the declaration; UNOPS coordinates communication beetween beneficiary and supplier; delivery is finalized through tripartite acceptance with the hospital. The supplier must fully cooperate with documentation, compliance and shipment requirements.Please note that recipient hospitals bear primary responsibility for humanitarian aid registration, declaration and post-clearance reporting, while UNOPS provides coordination, documentation support and overall facilitation throughout the process.Thank you.Procurement team.
