Establishment of Long-Term Agreements for the Supply of Armoured Vehicles for UN Web Buy Plus

New clarification added: Question : As the final destination country and end-user is undefined the manufacturers are not able to quote. Therefore , please kindly specify the final destination countries and end-users clearly. Otherwise it seems impossible to go further.Answer: Please note that the prices requested under this tender are on an FCA (Free Carrier) basis. As such, the exact final destination countries are not required at this stage. However, bidders must be able to provide after-sales service in at least the minimum list of countries specified in the technical specification sheet. Regarding the end-users, they are exclusively the United Nations (UN), internationally recognized development organizations, and national governments.

New clarification added: Question : Referring to the category 35 and 35.1.:Could you confirm if the 3rd row, left and right, should have opaque armor material instead of armored windows?Answer: There is no preference as long as the materials meet the minimum technical requirements outlined in the specifications.

New clarification added: Question: Please can the customer confirm whether it would accept a price quoted in pounds sterling (GBP)?Answer: Bidders should submit their bids in the currency specified in the tender documents. If a bid is submitted in a different currency, UNOPS will proceed in accordance with Section 1, Instruction to Bidders, Clause 16Question: Noting the narrative in the Tender Particulars, Scope of bid, paragraph 3, ‘the Supplier may be allowed to request for price adjustment’, please can the customer confirm if the Contractor is entitled to a price adjustment after every 12 month period? In the event that the customer does not agree with the price adjustment proposed by the Contractor, please can you confirm what the anticipated process would be for mutually agreeing a suitable adjustment to the price provided at bid?Answer: The prices included in this LTA shall remain fixed for an initial 12-month period from the date of signature of the Long-term Agreement. The supplier can request a price adjustment in every 12-month period, subject to the UNOPS approval process stipulated in the Procurement Manual. The new price will be subject to a reasonableness of cost assessment, and UNOPS reserves the right to accept or reject them.Question: The prospective Contractor notes that there is no index stated within the tender documentation. Please can the customer confirm if its expectation is that the price for year 1 is fixed and firm and not subject to adjustment and that thereafter it will be subject to an index for work performed in subsequent years?Answer - same as above Question: Please can the Customer confirm whether the local representation in the countries listed within the tender could be served via an engineering deployment model?Answer: There should be a local agent representing the Supplier in each of the countries listed in the tender and  any other country outside of the list if you are willing to supply.Question: Please can the customer confirm the process for agreeing delivery dates with the Contractor? Are these mutually discussed and agreed upon in writing between the parties prior to the issue of a Purchase Order?Answer: The Supplier should deliver the goods in accordance with the delivery period declared in Annex II – Form C: Financial Bid Form of ITB_2025_56335.Bidders must indicate the delivery time offered as part of its Financial bid submission. Question: Please can the customer confirm whether Contractors included in the LTA can elect to reject a Purchase Order if the required production capacity is not available for that given time period?Answer: If a product cannot be supplied due to limited production capacity during a particular period of the LTA, the Supplier must inform the Contract Manager in advance, and  temporarily mark it as unavailable in the electronic catalogue. This must be done before receiving a Purchase Order from the client. Once a Purchase Order is issued and accepted by the supplier, the Supplier must  deliver the product as per the agreed terms and conditions in the  LTAQuestion: Please can the customer confirm whether, in the event the customer elects to terminate the contract, the Contractor is entitled to claim costs for all work undertaken (including but not limited to labour and material costs) prior to the notice of termination?Answer: In case of termination of the Purchaser Oders, UNOPS will act according to UNOPS general conditions of Contract for goods. Please note that acceptance of UNOPS GCCs is a condition to qualify for this ITB. Question: Please can the customer confirm whether liability caps will be provided prior to contract award?Answer: Please refer to Article 6 – Insurance and Liability of the UNOPS General Conditions of Contract for Goods, which outlines the applicable liability terms.Question: UNOPS terms and conditions are included in the sample Long-Term Agreement (LTA) provided as part of the tender documentation. These terms outline the extent of the Contractor’s liability under the Agreement.Answer: Yes. Please can the customer confirm if this is correct?Answer: Yes, that is correct. UNOPS has not requested performance security for this tender, as indicated in the Tender Particulars.Question:  Please can the customer confirm which governing law applies under the LTA?Answer: As a UN organization, UNOPS is not subject to the national laws of any individual country. In the event of any dispute, art.17 of  the General terms and conditions of contract for goods will apply. Question:  Please can the customer confirm its position regarding liquidated damages (LDs) and how the 3% would be applied for late delivery? Are LDs calculated as a percentage of:a) the delayed vehicle price per day;b) the price of the relevant Purchase Order (which includes the delayed item(s)) per day;c) the original contract price per day, or;d) the total contract price (i.e. the aggregation of all purchase orders placed on the Contractor up to that date)?Our assumption is that a) is the case – please can you confirm?Answer:  In cases where only one or a few items within a Purchase Order are delayed, the contract price of the delayed vehicle price per day will be used as the basis for calculating the applicable liquidated damages (when/if necessary).

New clarification added: Question : Is the VPAM VR7 edition 2 acceptable for the 76 and Hilux variants?Answer: UNOPS has no preferences in terms of makes and models. All bids, makes and models will be evaluated equally. Fyi, the mentioned LC200 has been replaced by the successor LC300. Bidders are free to add under "Desirable options" additional equipment such as a ground radar for bomb detection as a cost option. This tender is a Long Term Agreement (LTA) valid for several years and issued as a Frame agreement, from which the UN can order without any further tendering. Hence UNOPS is not able to estimate a future quantity. 

New clarification added: Question : What vehicle is UN specifically looking for:Toyota LC200, 78 or 76. Many of the features on LC78 and 76 dont come standard . We have a turnover exceeding USD 3 million, a Quick Ratio above the required threshold, and a strong track record with organizations like UNDP and UNOPS. Given our establishment year, would our financial standing still be considered acceptable?Additionally, for this project, we have partnered with a globally recognized manufacturer with 30+ years of experience, serving clients such as the UN, NATO, and US SOCOM.We would appreciate your guidance on whether our financial profile and partnership meet the eligibility requirements.Answer: The eligibility and qualification criteria are clearly outlined in the tender documents, and the bidder must fully meet these requirements to qualify for the technical evaluation Question: We would like to clarify whether it is possible to participate in only a few categories, such as LHD or RHD vehicles (one of these categories), or if participation is mandatory for all categories.
