Description
The United Nations Office for Project Services (hereinafter "UNOPS") invites you to submit documents for prequalification of work contractors for the Construction of the Point Blanche Prison and House of Detention, in Sint Maarten, Dutch Caribbean.
This Pre-qualification is a formal method of assessing an organisation against a set of pre-determined criteria. This process is not related to specific solicitation process and focuses on a general assessment of an organisations operational, personnel capabilities and internal processes, including internal quality management and financial health.
While this process is not directly related to a solicitation process, UNOPS may use the results of this PQ exercise to create a shortlist of work contractors that may be invited to submit a proposal for the construction of the Point Blanche Prison and House of Detention, in Sint Maarten, Dutch Caribbean.

New clarification added: Clarification #14: In case of a negative response to the previous request for clarification ("Given the difficulty of translating so many pages, please confirm that for contracts drawn up in a language other than English it is possible to translate only the most important parts of the contract and not the whole") a 20-day postponement is required from the expiry date in order to carry out in a right time the translations of the documents required;Answer #14: Please refer to the answer to clarification #12.Clarification #15: Please confirm that for General Contractor companies that have been operating in the sector for more than 15 years it is sufficient to demonstrate point 1) of Annex 4 - as well as from the 10 turnkey projects - through the "Scope of Works" of the Company reported in the chamber of commerce documents sheet, which will be attached to the prequalification.Answer #15: To meet the "General Contractor experience" requirement, copies of contracts, purchase orders or similar documents must be submitted for the experience reported. For "turnkey projects" a signed Contract and certification of completion of each of the contracts issued by the Client or Financing Source must be submitted.Clarification #16: Please confirm that "vertical infrastructure projects" mean buildings taller than 1 story with a minimum construction total surface of 10.000 m2.Answer #16: Buildings of one or more stories are acceptable.Clarification #17: Please confirm that the Audited Annual Financial Report requested in Schedule 3 is composed of: Financial Statement - Assets, Financial Statement - Liabilities and Financial Statement - Income Statement + Independent Auditor's Report.Answer #17: UNOPS confirms that this is correct. Please take into consideration that the Audited Annual Financial Report must be compliant with your national legislation.Clarification #18: Please clarify the exchange rate to apply in the amount "Contract Value $USD" in the second column of the list. Schedule 4. It could be the exchange rate of the day of the completion of the project? Answer #18: According to document PQ_Section_II_Evaluation method and criteria_Amendment No.2, "if the currency of the financial statements is not in USD, the exchange rate used for translation should be based on the UN operational exchange rate as of December 31 of the year in question".Exchange rates are available in http://treasury.un.org/.

New clarification added: Clarification #11: The declaration required in Annex 5 "Returnable Proposal" will be signed by the chief executive officer and legal representative of the Company (duly authorized by the Board of Directors) or by a director of the Company duly authorized by a power of attorney. Please confirm that under these conditions the "authorized witness" requested at the bottom of the declaration is not required. Otherwise please clarify who could be the “authorized witness”.Answer #11: The authorized witness is required and it can be any person who is present at the time of signing.Clarification #12:Given the difficulty of translating many and many pages, please confirm that for contracts drawn up in a language other than English it is possible to translate only the most important parts of the contract and not the whole.Answer #12: It is acceptable to translate only the main pages of the contract which at minimum includes details such as the description of works, amounts and signatories.Clarification #13: Are there any requirements or standards regarding local / national / domestic content that foreign contractors or JVs must comply with, if the project is awarded? Which are?Answer #13: All companies looking to operate on Sint Maarten must adhere to local laws and regulations. The awarded contractor or joint venture will be solely responsible for adherence with these laws and regulations. While UNOPS may provide occasional guidance, the ultimate accountability rests solely with the awarded party.

New clarification added: Clarification #10: If shortlisted for this project, we will be preparing the tender from within two offices in different countries. Is it therefore possible to apply for two Company Representatives to get access to the Security Drive, by filling in two names and two email addresses on the 'RETURNABLE PROPOSAL SCHEDULE 9'?Answer # 10: We will accept a maximum of two people per company / joint venture to have access to the secure share drive. In this case, both must fill out the RETURNABLE PROPOSAL SCHEDULE 9 - UNOPS NON-DISCLOSURE AGREEMENT.

New clarification added: Clarification #1: If we participate as a Joint Venture, should I send the financial statements of each of the companies that are part of the JV?Answer #1: Correct, in case of Joint Venture, each of the companies that are part of this JV are required to provide their audited financial statements for the last three years of operation and the last audited annual financial report.Clarification #2: We kindly request to extend the time to submit clarifications.Answer #2: Please refer to Amendment No.1.Clarification #3: Returnable Proposal Schedule 3” (financial statements) states that all members of the combined joint venture must meet the criteria. Does this mean that it is sufficient that the net sum of the financial statements of the companies that make up the JV be greater than 100,000,000 USD?Answer #3: Correct.Clarification #4: What are the specific criteria for evaluating the annual turnover and solvency of the joint venture? Answer #4: Please refer to the “2. PQ_Section_II_Evaluation method and criteria” section Schedule 3: Financial Information to be Provided for the Assessment.Clarification #5: If one of the companies of the JV does not have a turnover of USD 100,000,000, how can it complement it? Is it possible with banking or financial letter support?Answer #5: It is not necessary for each company to have a turnover of 100,000,000, in this case the combined amount of all companies participating in the JV is evaluated.Clarification #6: Returnable Proposal Annex 4” (experience) states that the qualifications of each member of the joint venture will be combined. Does this mean that the net sum of years of experience of each company that makes up the JV must be greater than 15? Answer #6: Correct. Clarification #7: Do documents generated in another language need to be translated by a certified translator, legalized, or follow a process at the embassy? Or is a simple translation enough? Answer # 7: A simple translation is sufficient. Clarification #8: Should an Annex of returnable proposals 2 be submitted for each company that makes up the JV? Answer # 8: Correct, each of the companies that are part of the Joint Venture needs to submit the returnable proposal schedule 2. Bidders Details. Clarification #9: What is the deadline for submitting Returnable Proposal Annexes? Answer #9: This information can be found in the eSourcing General Tab. The date has been amended with a submission deadline for May 31, 2024.
