Multi distribution agreement is not allowed this may indicate that the vendor does not have a partner in Yemen to support after sales activities like warranty training proper installation.

New clarification added: Clarification:In the last amendment shared by your side, it states that we need to have a distribution agreement between the manufacturer and the Yemeni Company.However, we deal with the manufacturers to have a Letter of Authorization under our name (bidder) which is authorizing us to distribute the goods which in the end will be authorizing our Yemeni Partner to distribute the goods as we have a JV agreement.Can you please clarify if the above statement will work?UNOPS Answer:you need to submit the distribution agreement between the yemeni company and the vender you want to quote forand you need an authorization letter form the vendor to the company that will bid the offers, the authorization is not equivalent to the distribution agreement both should be submitted

UNOPS Answer:Please specify the price for option items in form C where this particular item is requested. In the pricing form (form B) you need to fill what is requested in the tender options items and should not be included in the price.However if the item is requested in the tender but you are asked to price it separately this means that it should be calculated in the total.

Amendments are colored with red. The purpose of this amendment is to unify the names of Forms G, H & I in both the word files and checklist. Provide more elaboration on the criteria related to the local agent in Yemen to be: "If the bidder is not Yemeni registered company, please provide details on your local representative in Yemen for the purpose of Installation, training and after sales services. New clarification added: Clarification:We would like to inform you that we are a trading company (Dellers) and we are not manufacturers. and In the Form MIF- there is the manufacturer’s information only , how do we fill it out.UNOPS Answer:Please note that under "MIF section 1: General information on the company" there is 2 tables; one is related to the manufacturer info and the other is for the dealer (agent). Bidder should fill both tables.Clarification:After we submit the Form K MIF – MANUFACTURER’S INFORMATION FILE (for bidders shortlisting purposes), can we update it whenever we want? UNOPS Answer:As per mentioned under tender's particulars, "Bidders shall be allowed to quote prices for one or more lots identified in this tender. However, bidders must offer 100% of the items specified for each lot and to 100% of the quantities specified for each item of a lot. New clarification added: Clarification:May I know why only the devices manufactured in China need provide the USA FDA certificates/approval? We think this policy seems discriminatory.Regarding the tenders of providing medical equipment, I found out that the conditions of the tenders mentioned that if the product comes from a Chinese company, the company should have a FDA certificate, and for your information, we are an agent of a Chinese company, but with CE certificate not FDA one. Do we have the right to provide products from a Chinese company with a CE certificate?UNOPS Answer: For chinese equipment they should have USA FDA , meaning allowed to be be solde the US a free sales certificate is allowed

New clarification added: Further elaborationi on previsous clarification: Question: Concerning item 3.6 Patient Monitor, please amend the following points as with the limitations provided it makes some other brands excluded while it is adopted worldwideand accepted technologies and to let more options offered to you: 1. 3.6.6 6. Design: to be Modular (Smart cable technology accepted) instead of (Not smart cable technology) as this technology is well accepted and adopted woldwide in USA, EUROPE, JAPAN and our region and showed very good performance and flexibility in using required parameters.UNOPS further elaboration: The described need in the tender is a modular design monitor which have actual Modules that can be plugged in or Out as needed, this help in upgrading the monitor for newtechnologies that can be added afterword, the Smart cable technology may share the nature of customizing each monitor for the patient need by adding the needed cables(interfaces) or even can be upgraded because the monitor will have all the needed hardware and software of existing technologies only (current), (smart Cable technology)will have a close system accessories because there is a ship in the smart cable, we accept that this technology is superior than the configured monitor but it doesn’t fulfill all thebenefits that a modular design provide one of which the easy swap out of the modules when maintenance needed we also will not accept any semi modular design meaning thatno configured vital sign embedded in the monitor is allowed.Question: 2. 3.6.7 Configuration: to add at the end of the sentence the followings: "Multi Connector technology combined with Multi parameter vital sign is accepted". actually this point is related to 3.6.6.6 as the Smart Cable Technology uses Multi Connector.UNOPS further elaboration: Refer to the above clarificationQuestion:3. 3.6.8 f. to be changed to "Masimo Spo2 technology or equivalent" as this limitation is specfic to certain brand. UNOPS further elaboration: Masimo Technology is not limited to any brand all vendors have access to this technology And this is a well known fact.Accordingly the requested changes are rejected.

The agent or the manufacturer?UNOPS Answer:To be eligible for participating in this RFQ, bidder can be either Manufacturer of the offered goods or a representative of the manufacturer (Agent).In case the manufacturer of the offered goods submits the bid (bidder), he should have a local representative in Yemen responsible for Installation, training and aftersales services (agreement between both parties should be submitted).In case the manufacturer's representative in Yemen (Agent) submits the bid (bidder), he should have an authorization form the manufacturer authorizing him to provide the goods (Form F: Manufacturer’s Authorization Form should be submitted). New clarification added: UNOPS Clarification:Concerning item 3.6 Patient Monitor, please amend the following points as with the limitations provided it makes some other brands excluded while it is adopted worldwide and accepted technologies and to let more options offered to you:1. 3.6.6 6. Design: to be Modular (Smart cable technology accepted) instead of (Not smart cable technology) as this technology is well accepted and adopted woldwide in USA, EUROPE, JAPAN and our region and showed very good performance and flexibility in using required parameters.2. 3.6.7 Configuration: to add at the end of the sentence the followings: "Multi Connector technology combined with Multi parameter vital sign is accepted". actually this point is related to 3.6.6.6 as the Smart Cable Technology uses Multi Connector.3. 3.6.8 f. to be changed to "Masimo Spo2 technology or equivalent" as this limitation is specfic to certain brand. Clarification:The requested changes are rejected.

New clarification added: Clarification: We would like to bid on the Tender No. RFQ/2022/42301 - Supply And Delivery Of Medical Equipment.Our question in preparation is whether we can prepare a quote for individual items as not all items in the different packages are in our scope. UNOPS Answer:As per mentioned under tender particulars; Bidders shall be allowed to quote prices for one or more lots identified in this tender. However, bidders must offer 100% of the items specified for each lot and to 100% of the quantities specified for each item of a lot. Evaluation will be done per lot.Accordingly quoting for individual items is not accpeted.

New clarification added: Clarification: Regarding the custom clearance, will the supplier be given necesary documents to avail Custom Duty Exemption? OR will the supplier have to pay full Custom Duty at Yemen? UNOPS Answer: UNOPS shall take care of the customs exemption and customs clearance at Yemeni ports. The supplier is obliged to provide UNOPS with the required approved and consistent shipping documents in a timely manner (immediately once the shipment sails from the country of origin's port) to facilitate the process.
