Description
1. INTRODUCTION:
The United Nations - Mechanism for International Criminal Tribunals (UN-MICT) requires a comprehensive international property and liability insurance program to be in place with effect from 01 November 2017 covering one (1) year term initially. The UN-MICT hereby seeks Expressions of Interest from suitably experienced broker firms to indicate their interest to participate in a tender for the service of negotiating and advising the UN-MICT on its insurance arrangements.
2.0 BACKGROUND:
2.1 The UN-MICT was established by the United Nations Security Council on 22 December 2010 to carry out a number of essential functions of the International Criminal Tribunal for Rwanda (ICTR) and the International Criminal Tribunal for the former Yugoslavia (ICTY) after the completion of their mandates. The UN-MICT comprises two (2) branches, i.e. one in The Hague, Netherlands, and the second in Arusha, Tanzania. Furthermore, it has a field office in Kigali, Rwanda, belonging to the Arusha branch, and a field office in Sarajevo, Bosnia and Herzegovina, belonging to the Hague branch.
The Hague Branch
2.2 Since its inception the MICT-Hague branch has cohabitated with the ICTY. It will continue to do so until the ICTY’s closure on 31 December 2017. Thereafter, the MICT will continue to occupy its current premises. At that time, most ICTY assets will have been transferred to the MICT. The MICT Hague branch’s property and liability insurance requirements will therefore, by and large, be the same as those currently shared by the ICTY and the MICT-Hague branch.
2.3 The MICT-Hague branch premises includes two (2) court rooms, administrative offices and legal offices, a library and archives, and a parking garage housed at its Headquarters located in The Hague, the Netherlands.
2.4 The MICT-Hague further operates a detention unit (UNDU) located within the confines of the Penitentiëre Inrichting Haaglanden (penitentiary complex “Haaglanden”) in Scheveningen, The Hague.
2.5 In addition, MICT-Hague branch has field offices located in Sarajevo, Bosnia-Herzegovina (until December 2018) and Belgrade, Serbia (which will be closed by 31 December 2017) to assist in its work.
2.6 The UN-MICT leases its facilities in The Hague and Sarajevo from private landlords. The detention facility in The Hague is leased from the government of The Netherlands. The Belgrade facility is located within the UN Serbia complex, and it will close this office by end of December 2017. The landlords are required to provide risk insurance for these premises.
2.7 It should be noted that the MICT-Hague branch provides parking, office or limited free space to the following organizations/companies/contractors.
(a) Residual Special Court For Sierra Leone (RSCSL) – Office spaces
(b) Organisation for Prevention of Chemical Weapons (OPCW) – Parking spaces
(c) Court reporters (free space)
(d) Transport police (free space)
(e) Maas International (vending machines) (free space)
(f) SAB Catering Company (free space)
Arusha Branch
2.8 In Arusha, the MICT has its headquarters in its newly constructed compound in the Lakilaki area at the outskirts of Arusha, Tanzania. This compound is owned by the MICT and not shared with any third parties. The MICT has occupied this compound since 5 December 2016. The main buildings on the Lakilaki compound are an office building, a court house, and an archives/library building. It further includes three 6-unit prefabricated offices, an underground water reservoir with pump house, a mechanical yard, a parking lot, and two security guard houses.
2.9 A small team of 5-10 staff members as well as the MICT-Arusha branch archives remain in the MICT’s previous office location at the Arusha International Conference Centre (AICC), a large Government-owned facility that, besides the MICT, also houses several other tenants. The MICT leases space (one-half of a floor of offices, and archive vaults) from the AICC. The MICT expects to vacate the AICC at some point in 2018 at which point both staff and archives will be relocated to the Lakilaki compound.
2.10 In addition, the MICT in Arusha operates the following facilities:
• United Nations Detention Facility (UNDF). The UNDF comprises several buildings inside the premises of the Tanzanian Prison Authority. This area includes a warehouse. The UN has exclusive right of use of and access to the UNDF.
• The “RAP house”. This is a residence for (currently 11) Released and Acquitted Persons (RAP) who remain there until their relocation to a third state/country. This residence is leased from a private company.
2.11 In Kigali, Rwanda, the MICT leases an office villa from a private vendor. Included in this office compound is a small annex which houses a medical clinic for victims and witnesses. The compound includes a small swimming pool; however this pool has not been filled with water since MICT’s occupation of the premise, nor is there any intention to do so.
