UNOPS hereby invite your company to bid for the supply of Analyzers to the Philippines and multiple destinations. UNOPS wishes to establish non-exclusive Long Term Agreements (LTAs) with multiple vendors.

New clarification added: One of the prospective bidders raised the question do they need to provide a distributor list.Clarification from UNOPS:- Pls be requested to go through Section III - Returnable bidding forms, Section B - Documents, Certifications and Standards required, to be presented by the bidder in the offer. Also, kindly go through the various clarifications posted in the system.

New clarification added: One of the prospective bidders raised a question to confirm whether the calorimetry technology is acceptable for lot 1.Clarification from UNOPS:- Fluorescent technology depends on two wavelengths rather than a single wavelength, and generally, fluorescent technology is capable of detecting more analytes due to higher sensitivity than calorimetric technology. Therefore, calorimetric technology is not acceptable.

New clarification added: One of the prospective bidders inquired that LTO must be owned by bidder or local distributors.UNOPS Response: - The LTO must be owned by the bidder. Bidders are requested to see the crteria for the JV / Consortium as issued by amendment no 1.

New clarification added: One of the prospective bidders would like receive clarification on below points ; Please advise if DAP conditions would be acceptable or not ? UNOPS response:- The required INCOTERM under this specific tender is DDP and bidders are requested to quote accordingly.Please clarify the entity that needs the LTO as the sentence is open to interpretation. Can a company not registered anywhere in the Philippines, propose brands that are represented locally by duly registered distributors? UNOPS response :- Kindly go through the tender conditions carefully before submitting an offer. "Valid Certificate of Distributorship (as First Tier Distributor) " clause seems to exclude international trading companies that do not operate on distributorship basis. Pls advise whether Manufacturer’s authorization is acceptable. UNOPS response :- At the time of the offer, the Bidder must present a valid and current License to Operate (LTO) as a medical device distributor issued by the Philippine Food and Drug Administration (FDA) on behalf of the Supplier/Bidder. Manufacturer authorization is acceptable instead of a valid certificate of Distributorship.

New clarification added: One of the prospective bidders inquired that does FCA term is equivalent to EXW term.Clarification from UNOPS:- Bidders are requested to quote as per FCA INCOTERM. At the time of placing the order, UNOPS will ask for the freight charges for the requested destination(s) and orders will be placed on DDP.

New clarification added: One of the prospective bidders inquired whether they need to provide the valid certificate of distributorship and license to operate (LTO) at the time of quotation submission.Clarification from UNOPS:- Yes, LTO is a requirement at the time of submission of offers. The interested bidders are required to go through Section III - Returnable Bidding Forms carefully. The detailed requirement has been written on the tender document.

New clarification added: One of the prospective bidders inquire how many locations expected to be installed throughout LTA period. Clarification from UNOPS:- The designed locations will be informed at the time of issuing call-off order against LTA or asking for freight cost and domestic transportation cost within designated locations. Pls note that the primary locations of these LTA are the country of the Philippines. However, UNOPS may consider using these LTAs to other countries within the Asia Region, if requirement arises.

New amendment added #1: Following modification to the ITB Document is made through this Amendment I, with reference to above ITB.This amendment has been issued to include the following criteria for the evaluation in case the bids are submitted as a Joint Venture/Consortium/Association.All parties of such joint venture, consortium or association shall be jointly and severally liable to UNOPS for any obligations arising from their offer and the contract that may be awarded to them as a result of the solicitation process;The offer shall clearly identify the leading partner to act as the contact point to deal with UNOPS, as detailed in the appropriate returnable form/schedule. Such entity shall have the authority to make decisions, binding upon the joint venture, association or consortium during the bidding process and, in the event that a contract is awarded, during the duration of the contract; andThe composition or the constitution of the joint venture, consortium or association shall not be altered without the prior consent of UNOPS.The eligibility criteria will be applicable for each joint venture partner.The qualification requirements mentioned in the qualifications section of the e-sourcing and in technical requirements ( like licensing, after sales service etc) will be considered for all partners of the JV combined. It means the JV will qualify even if one of the partners qualifies or they combinedly qualify.

New clarification added: One of the prospective bidders raised a clarification on the requirements of performance guarantee to be submitted as well as UNOPS payment conditions. Clarifications given by UNOPS :-Kindly note that there are no requirements of performance guarantee under this tender. Also, payment to the LTA holder will be initiated only after the satisfactory Supply, Commissioning and Training of the units at the designated sites as per the specific call off orders against the LTAs. Interested bidders are requested to go through the tender documents carefully before submitting an offer.
