New clarification added: Clarification Request 10:Dear Team,Thanks for confirming that both proposal and performance guarantees are supposed to expire upon completion of their respective terms.Please can you clarify how are the guarantees ‘non-refundable’ in this case? We understand that we should be able to recover full guarantee amounts from our banks if there is no breach of contract or bidding process during the guarantee issuance period. Please can you confirm?UNOPS Clarification 10:UNOPS advises that the Proposal Security (Bank/ Insurance Company Guarantee for Proposal) and the Performance Guarantee (Bank Guarantee for Performance) are Non-Refundable meaning they will not be recovered by UNOPS. The arangements made by the bidder and their respective banks to recover the guarantee amounts are agreements outside UNOPS accountability.

New clarification added: Clarification Request 09:With reference to UNOPS clarification 03 dated 22 Oct 2019, it is advised that the proposal and performance guarantees will be non-refundable.For the proposal guarantee which is to have a validity of 90 days, if we comply with the tender process then the proposal guarantee should be returned to us on completion (should not be called upon).It should only be called upon in the event that we pull out or in some other way do not comply with the process.If the performance guarantee is called upon due to breach of contract or non-compliance with requirements then it cannot be refunded but otherwise it should be returned to us (not called upon) at the end of the process.Please can you confirm our understanding?UNOPS Clarification 09:UNOPS confirms the Clarification 03 dated 22 Oct 2019. Further, UNOPS advises that the Proposal Security (Bank/ Insurance Company Guarantee for Proposal) and the Performance Guarantee (Bank Guarantee for Performance) are Non-Refundable. The Proposal Security validity period is required to be 90 days from the date of submission deadline and once the procurement process is completed, it can be returned to the bidders upon their request.The Performance Guarantee (Bank Guarantee for Performance) will be requested to be provided from the selected bidder after the contract award, and it is required to be for the total duration of the project period. Upon the final implementation of the contract, and once the contracted services are completed to the satisfactory performance, the Performance Guarantee (Bank Guarantee for Performance) can be returned to the bidder upon their request.If there is a breach of contract or the contractor does not comply with the requirements, it will be used to cover the losses.

New clarification added: Clarification Request 8:Dear Sir/Madam,Can the criteria on the Annual Turnover requested for the average turnover for the last 3 years amended to be 1,200,000.00 USD?UNOPS Clarification 08:UNOPS advises that interested bidders should refer to the Revision 6 Amendment to this RFP for the revisions on the Qualification Criteria, under 1 and 4, and on the Evaluation Criteria V2 document uploaded under the documents section of this RFP.

New amendment added #6: The following criteria of the Stage: Qualification Criteria and on the Evaluation Criteria document is amended to read as follows: - Returnable Proposal Schedule 5 - Financial capability: Proposer’s average annual turnover for each of the last 3 (three) calendar years (2016, 2017 and 2018) was equal to or greater than $ 1,000,000.00 (US Dollars One Million) per financial year - Returnable Proposal Schedule 5 - Relevant Specific Experience: Proposer must provide 3 (three) examples completed during the last 3 (three) years, of the previously implemented services of similar nature of Building Condition Survey.

New clarification added: Clarification Request 07:Dear Sir/ Madam,Can you please amend the Qualification criteria on the Annual Turnover requested, as we feel that this is too high for the companies that can provide these kind of services.Further, we belive that the costs to complete the whole scope of the requested services is much lower than this criteria, hence our reques to amend the criteria.UNOPS Clarification 07:UNOPS confirms that the Qualification Criteria for the Financial capability - Proposer's average annual turnover for each of the last 3 (three) calendar years (2016, 2017 and 2018) was equal to or greater than $ 3,000,000.00 (US Dollars Three Million) per financial year.However UNOPS advises that this amount might be considered to be lowered - if the indication from the interested bidder is known, for the revision to be further approved by UNOPS.

New clarification added: Clarification Request 05:Our legal counsel has reviewed the Proposal Guarantee in Schedule 2 and suggests the below revisions to it:This is an on demand guarantee. This should ideally be changed to a conditional guarantee by deleting the words “your sole and absolute judgement” and stating that a court order confirming a breach has to be provided. Reference to Article 15(a) not applying should as a result be deleted. Failing this we should have an opportunity to at least remedy such breach in a reasonable time before the guarantee is called upon.The duration of the Guarantee should be clearly specified and any extension should be mutually agreed.UNOPS should only be able to assign to an affiliate and not to any party.The refence in the second last paragraph to Articles 34 and 35 being excluded should be removed as we, and the bank, will need certainly as to which law and courts shall apply to such a matter.Please confirm if these are acceptable, if yes, kindly send across the revised word document for us to complete. UNOPS Clarification 05:UNOPS advises that the RFP RETURNABLE PROPOSAL SCHEDULE 2 - PROPOSAL SECURITY FORM; BANK/ INSURANCE COMPANY GUARANTEE FOR PROPOSAL is the standard RFP template form used in all UNOPS tender openings worldwide and the language content corresponds with the official requirements, therefore any revisions to it are not allowed.

New clarification added: Clarification Request 04:Our company has expressed interest in applying for Design Consultancy Services for Works-Schedule RFP Case No: RFP/2019/11712. Due to the requirements that are presented in ToR and the nature of this project, it will take time to complete the proposal in order to provide the quality of the work that is required by UNOPS, therefore we would like to request to extend the deadline for the submission of the proposal minimum for 2 weeks.We are in the process of completing the requirements from this ToR.We hope our request will be considered.
