New clarification added: Quiestion 32: We are interested in submitting a proposal for the supervision consultancy. We have done similar projects in the region (Grenada, Jamaica, Trinidad) as well as one currently enaged in another XXXXXX (Projec in Barbados) and note that registration with the relevant engineering regulatory body was not a requirement for supervision works, unless design services are being provided for approval purpose for which is not the case here in this RFP. Also registration with the engineering regulatory body is a subjective process and may protract contract signing. The project being of small scope and short duration, registration with the engineering regulatory body should be waived for this RFP.The waiver should also apply to the extent of laboratory testing and surveying equipment being requested of the supervising consultant. The supervising consultant would normally witness tests conducted and review the respective reports.Answer 32: For this procurement, professional registration of the supervising engineers remains a requirement. The supervision contract involves certification of works, verification of compliance with approved designs, and issuance of technical reports that form part of the Employer’s record. These functions must be carried out by appropriately registered professionals. Registration does not imply that the Supervision Consultant is providing design services or assuming design liability. It ensures that the professionals certifying the works are subject to a recognized regulatory framework and can exercise professional accountability within the jurisdiction.With regard to laboratory testing and surveying, the intention is not for the Supervision Consultant to self-perform all tests with in-house equipment. The requirement is to witness, verify, and review testing and surveying outputs to confirm that the Contractor’s work meets the specified standards and undertake confirmatory tests as and when required. Access to suitable laboratory services and competent surveying capability is expected, whether through in-house resources or subcontracted providers subject to approvals.

New clarification added: Question 29: Given that the project pertains to building works (eg checking for levels, alignments, dimensions, excavations) can the on-site verifications be done by an Engineering Surveyor instead of a Land / Topographic Surveyor with the relevant surveying equipment?Answer 29: For this project, on-site verification of levels, alignments, dimensions, and excavation limits may be performed by an engineering surveyor equipped for construction control. The project does not require a new topographic or cadastral survey during the construction phase, as the relevant topographic and boundary information has already been compled. The key requirement is that the surveyor maintains accuracy against the established project control points on site using calibrated surveying instruments.Question 30: What are the approximate construction budgets for the 3 components of the project?Answer 30: Please note that the construction budget is not to be disclosedQuestion 31: Would it be more cost effective for the consultant to attend sampling and testing done by the contractor and review the respective reports in lieu of duplication of effort by both the contractor and consultant?Answer 31: Please adhere to the testing validation requirements.

Answer 13: The Consultant shall provide the Services as stated in SCHEDULE 3: REQUIREMENTS OF THE EMPLOYER.Question 14: Currently, there are no design drawings and specifications available. Please clarify who retains the design liability in the event the Contractor raises a Request for Information/Clarification or proposes an alternative solution. We note several disadvantages/concerns where the Engineer/Supervisor does not take ownership:A dispute may arise as to whether a defect is a result of a design fault (Design Error/Oversight) or a construction error (Supervisor Error). The supervisor may require time to review and understand the design, causing delays. The supervisor may disagree with the proposed solution.The supervisor may be reluctant to take responsibility for design changes or site issues that stem from the original design, as they did not create it.Answer 14: The Engineer will review construction drawings and provide clarifications for the Contractor's RFIs based on the project's design documents. If a technical issue requires the Designer’s input, the Engineer will notify the Employer to arrange a formal review and response. Please note for the mortuary I need the Sq meter calculations of all inner walls of the mortuary room. This required for calculating how much steel cladding is required for the walls. I also need the mortuary room floor Sq meter to calculate the price for MMA flooring. I hope I will receive a response this time.Answer 12: Please refer to Answer No. 3. This tender relates to supervision services. The Supervision Consultant is not required to carry out any design or construction activities. New clarification added: Question 05: The slide show depicted "delay damages" and "aggregate maximum amount of delay damages" at 0.3% daily and 10% respectively. Is this to say that the Construction Supervisor is liable for General Contractor construction delays (otherwise known as liquidating damages)? How are Construction Supervisor "delays" going to be quantified?Answer 05: The delay damages in the slide relate to delays in the performance of the Construction Supervisor under the consultancy contract. They do not transfer the General Contractor’s construction delay exposure to the Construction Supervisor. The Construction Supervisor is not liable for liquidated damages arising from contractor delays.The delay damage applies only where late performance by the Supervision Consultant causes measurable impact on the timely delivery of the consultancy services.Question 06: Are we correct in understanding that the Construction Supervisor must create a theoretical construction schedule in our submission, even though the Construction Supervisor is not self performing the physical works and construction is to be awarded to others? The selected Contractor will need to submit their own proposed construction schedule based upon their internal means and methods.Answer 06: Yes, the Construction Supervisor must submit a work programme. This is a supervision programme, not a production schedule.The purpose of the programme is to show how you will deliver supervision services on time, align your activities with an assumed construction sequence, and confirm resources for inspections, certifications, reporting, and handover supportAs for the Contractor’s schedule, the Contractor will later submit their own detailed schedule based on their means and methods and the supervision consultant's programme will be updated once that schedule is approved.Question 07: Please confirm if the Construction Supervisor is responsible for design or AE project changes or reviews. Or will the awarded AE contractor assume all responsibility and liability?Answer 07: The Construction Supervision “Engineer” under this tender is not the Engineer of Record or Architect of Record. The supervision consultant is not the final design sign off party for structural or architectural documents, and it is not taking design liability for the works. The role of the supervision consultant covers among other roles indicated in the tender document such as review and comment on contractor submittals, verify compliance of works with approved design and contract, Inspect, certify, and report progress, support testing, commissioning, and handover, issue site instructions within the contract scope.The supervision Consultant’s role does not cover approving design as the legal EoR or AoR, stamping drawings, taking responsibility for permanent design, or replacing the design consultants or authorities.Question 08: Will the UN be utilizing a Design Build (DB) or Design Bid Build (DBB) contract vehicle for the selection of a General Contractor? Has or will an Architect and Engineering (AE) firm be solicited and selected for the design of this project?Answer 08: A design firm is already working on the technical plans, and we will share the specific details about the construction contract when the Construction bidding process is launched.Question 09: What are acceptable means of submitting a Performance Security (PS)?Answer 09: The Performance Security shall be submitted in the form of a Bank Guarantee issued by a bank approved by the Employer.
