New clarification added: Dear SIr,Please find below bidders clarifications & UNOPS replies:Q1- Tax and Customs Exemptions , The delivery requirements state that UNOPS will obtain the relevant Israeli tax and customs duty exemptions, and that the bidder will provide all required documentation. However, it is also noted that UNOPS shall not be held liable if such exemptions are not granted. Could UNOPS please clarify whether, in the event that the Israeli authorities do not grant the exemptions, the successful bidder would then be responsible for paying any applicable taxes and customs duties?UNOPS Reply: Refer to Amendment No.1 , paraghrapgh (Tax and Customs Exemptions) was amended.Q.2: Delivery Time and COGAT ApprovalCould UNOPS please elaborate on the total delivery time and the process related to COGAT approval, including the formal shipment notification?UNOPS Reply: COGAT delivery times vary depending on the type of goods being imported, and there is no specific or fixed timeframe. Therefore, immediately after the contract is awarded, the successful bidder shall provide all required documentation related to the goods, enabling UNOPS to submit them to COGAT for approval to import the goods into the country. Once COGAT approval is granted, UNOPS will notify the successful bidder, who shall commence shipment without delay.The current requirements specify a maximum manufacturing time of 40 days and a maximum shipment time of 40 days to the final destination, resulting in a total of 80 days (DAP).If COGAT approval causes a delay in shipment and the 40-day shipment period cannot be met, will the total delivery time of 80 days be extended accordingly? Alternatively, does the 40-day shipment period begin only after COGAT approval has been granted and UNOPS has issued the formal shipment notification?UNOPS Reply: Yes, the 40 days shippment requirement will start after GOCAT approval is granted and UNOPS has issued the formal shipment notification. Given the uncertainty, particularly the potential for prolonged COGAT approval, UNOPS will remain flexible to extend the delivery time if this is the case. Liquidated DamagesQ3. The delivery requirements specify liquidated damages of 0.3% of the PO/Contract amount per day of delay, up to a maximum of 10% of the total PO amount.Could UNOPS clarify whether delays caused by the COGAT approval process would be considered grounds for applying liquidated damages? Given that COGAT approvals are subject to external factors beyond the contractor’s control, there is concern that such delays could result in penalties for circumstances outside the bidder’s sphere of influence.UNOPS Reply: liquidated damages will not be applied because of delay in obtaining the COGAT Approval, but it will be applied if the successful bidder delay in providing all supporting documents required by COGAT (e.g., specifications, pictures, catalogs, etc.) to UNOPS for onward submission to secure COGAT approval.Q4. We are interested in participating in the subject project and would like to kindly clarify whether international bidders are eligible to participate in this tender, as the tender mentions regulatory liaison with the Ministry of Health of Palestine, as needed. We look forward to your kind confirmation.UNOPS Reply: this Bid is open for local & international bidders (open competition) , as mentioned under evaluation criteria 3.6 (Bidders must submit a local agent or official representative in Palestine for international bidders in line with Section II.1: Technical Requirements. A copy of a valid registration license of a local agent or official representative in the West Bank shall be submitted.) In addition, please note that criteria 3.3 Local bidders or local agents of international bidders shall submit a valid Registration with the Ministry of Health of Palestine.Q.5 We require clarification from the UNOPS side about the delivery destination to GAZA: Will UNOPS coordinate this tender for Gaza or will we coordinate it ourselves?UNOPS Reply: as mentioned under (Section II ), The awarded supplier is responsible for delivery of goods DAP + unloading (Delivered at Place) to the final location in Gaza Strip. This includes locations in the South, Middle, and/or North of the Gaza Strip. Q.6 Kindly conseder extending the submition date for ferther 2 weeks UNOPS Reply: Extending the deadline would be difficult due to the urgent needs. Q.7 A: Are the quantities stated in the tender final, or are they only for unit price identification?UNOPS Reply: Refer to (Section II.2: Delivery requirements and Comparative Data Table) under (UNOPS Right to vary requirements)Q.7.B. Regarding Item 1.9 / LOT 1 – BEmONC, Radiant Heater, we would like to confirm the required configuration.UNOPS Reply: The requested item is a mobile radiant heater. Bidders should adhere to the tender specifications.Q.8 Kindly clarify whether you are requesting a mobile radiant warmer without a bed (i.e., not an open incubator, but only a mobile warmer unit).Please confirm if our understanding is correct.UNOPS Reply: Yes, the requested unit is a mobile radiant warmer without a bed (a standalone mobile warmer unit). Q.9 At the lot number 1 in part 3.7 and lot 2 part 2.24 Portable ultrasound , you asked for convex 2-5 Mhz, then you asked for another convex probe with the same range 2-5 Mhaz, please confirm that you need 2 convex probes with the same range ? UNOPS Reply: Please see Amendment 01 with the amended specifications for Item 3.7 Portable Ultrasound under lot 1 & Item 2.24 Portable Ultrasound under lot 2Q.10 The tender document states under 'COGAT Approval', Section II.2: “The bidder shall assume all risks and liabilities associated with the approval or clearance of the goods by COGAT.” This raises the question: what specific risks and liabilities does UNOPS intend to convey in this clause? For instance, if COGAT denies approval for the goods to enter Gaza, the shipment cannot proceed. In such a scenario, would the contractor be denied reimbursement for expenses incurred in preparing, manufacturing and attempting delivery of the units?UNOPS Reply: Refer to requirements described in (Delivery requirements and Comparative Data Table), however it is also mentioned below:.Storage of Goods: While UNOPS will facilitate the COGAT approval process, the successful bidder shall be responsible for storing the goods at their factory or warehouse, at no additional cost, until COGAT's approval is issued and a formal shipment notification is issued by UNOPS.Shipment Instructions: Failure to adhere to UNOPS' shipment instructions will result in the successful bidder bearing any storage costs or applicable demurrage charges.Kindly note that UNOPS plans to redirect the goods to the West Bank as noted in Delivery requirements and Comparative Data Table, in case COGAT rejects the delivery of goods to Gaza.Rerouting of Goods: If COGAT approval is not granted for goods intended for Gaza, the successful bidder must reroute the shipment to the West Bank upon UNOPS' request, at no additional cost.
