Description

Labour migration abroad has a long history in the Pacific and takes many forms, including seasonal migration to  Australia and New Zealand through government organized programs; the employment of seafarers on foreign vessels; skilled migrants who spend anywhere from a year to their entire working lives in other Pacific Island countries or in other parts of the world (often working as nurses, peacekeepers, accountants and teachers); and migrants who leave permanently, such as Pacific Islanders eligible to go to New Zealand under the Pacific Access Category.

At present, Vanuatu is undertaking two concurrent review processes related to labour migration. The first is a PACER Plus supported review of the National Labour Mobility Policy (PACER Plus Review), and the second is an internal government-led review of existing labour migration schemes in the region (Internal Review). The Government of Vanuatu has also identified that Vanuatu’s Seasonal Employment Act 2007, which governs outward labour mobility, is in need of review. The Government of Vanuatu has requested that, after the conclusion of these two existing reviews, the ILO undertake a review of Vanuatu’s legislative framework with respect to outward labour migration and support a subsequent reform process.

The first objective of this consultancy is to undertake a review and analysis of the national legislation of Vanuatu governing sending labour migrants abroad, based upon the findings of the two reviews referred to above and international labour standards, and in consultation with the relevant tripartite stakeholders and additional stakeholders to be recommended by the Government of Vanuatu. The consultant will work in close coordination with the Migration MPTF project implementing team. The second objective of this consultancy is to support a subsequent law reform process. This process should be conducted in close consultation with the relevant government departments in Vanuatu.
