The United Nations Office for Project Services (hereinafter referred to as UNOPS) is pleased to invite prospective bidders to submit bid for Supply and Delivery of Water Pumps (to pump drinking water(potalbe water)) for Ethiopian Ministry of Water and Energy, Addis Ababa, Ethiopia, in accordance with the UNOPS General Conditions of Contract and the Schedule of Requirements as set out in this Invitation to Bid (ITB).

New clarification added: Question:Greetings, we are in the process of preparing our bid submission for the project, however the payment conditions for this tender seem to be extremely limiting. We feel that the payment terms put the bidder/ supplier at undue risk of delays in payments.We have therefore decided to request you to make the payment terms more reasonable and to seek confirmation on some more technical points as follows.For this tender thinking from the suppliers point both the 80% and the 20% payments are extremely uncertain and therefore unreasonable and puts the suppliers at a massive RISK. We explain this as follows,Please note the supplier has to depend on the VESSEL SCHEDULE (which is extremely uncertain as is a global fact) Second uncertainty is after the equipment reaches Djibouti, we all are aware of the political and war like situation that prevails in the region, is the logistics and transport in land etc dependable is what we all need to think. Third uncertainty would be for any reason if the shipment is stuck at the port – delayed payment of duty, strikes etc there could be many reasons - anything could happen again the supplier is stuck.THE REASONABLE SOLUTION COULD BE: Having done his part up to shipment the supplier should be relieved of the major payment of equipment part at least, supplier or manufacturer at least recovers his costs. For example accept one of following,As usual to pay the 80% to the supplier against FCA / FOB delivery against shipping documents. Note : If the bid was issued by WDC they would have done this in any case. OR At-least pay the 80 % within 30 days of the shipment (date of BL) against original shipping documents irrespective of whether the equipment has reached the site OR not.The balance 20 % payment upon reaching and inspection at WDC Addis Ababa, please note there have been incidences in Ethiopian contracts where suppliers have been stuck with the last 10 or 20 % payments not paid for years. There are couple of ways to address this uncertainty,To have the equipment inspected at the respective factories either by the client OR by a independent third party inspection agency like TUV or BVQI etc. This way the 20 % payment can be released immediately upon the receipt of the equipment at WDC. It’s much simple. OR There could be a maximum number of days from the date of shipment ( say 60 days ) after which the 20 % payment could be released by WDC . One of the 2 above solutions could make the bidders have the confidence that the last 20 % will indeed be released and not drag on for ever.Certificate of conformity ( COC ) : The UN contracts generally stipulate the requirement of a COC for the pumps to be issued by SGS and submitted to the UN office. The tender specifications do not mention the COC requirement. Kindly confirm would a COC be required for the pump sets to be supplied as it will mean a large additional expense and time required.Technical Querry For Lot -5, surface pump with duty point 5 lps @120 m (Diesel driven) – the tender mentions air cooled engines to be used. It is a well known fact that liquid cooling is much more reliable than air.1) Since the pumps will be remotely located it is better to use water OR radiator cooled engines for the pump-sets. OR at least allow manufacturers the option to use their choice of cooling for the engines.2) Also not all submersible / surface pump manufacturers manufacture diesel driven pump sets, so is it acceptable if the one diesel driven pump set is from a different manufacturer.Request please confirm acceptable to the two points above for the diesel engines. CABLE SIZES FOR SUBMERSIBLE PUMP SETS : We have observed that the the cable sizes are provided in the technical documents only for item no 30, 31 & 32 of lot no 1 -submersible pump sets and for all the items of lot 2 - surface pump sets. Request please provide the submersible pump cable sizes for the remaining items of subbmersible pumps urgently. This will help all bidders to offer same size cables and will make evaluation job very easy. Otherwise various bidders can offer different cable sizes and it can result in a big issue during evaluation of the submersible pump items.Please clarify all the above and allow us atleast 10 working days time after providing the cable sizes to check the provided sizes, obtain offers for the required cables from manufacturers and complete the offers accordingly.In case cable sizes are not provided for any reason it is more important to allow more time for submission because in that case the pump manufacturers have to compute the cable sizes and then offers from manufacturers need to be obtained, prior to preparaing the bid.We believe that UNOPS - as usual will have a unbiased & Pragmatic - analysis on the payment terms and in order to encourage participation and competitiveness will propose better terms of payment as suggested above.UNOPS response:Please note that there is no change in the payment terms stated in the tender(80 % of the Contract Price shall be paid on receipt of the equipment at Ethiopian Ministry of Water and Energy, Addis Ababa, Ethiopia and upon submission of payment documents, and the remaining 20% shall be paid after inspection and acceptance by the partner). UNOPS believe that the payment terms is reasonable and use DAP incoterms. Please note booking a vessel is part of the bidder proactive planning to make things going properly and there is no issue in relation to Dibouti port and no war curerently in the region. Apart from this, the lion share of import to Ethiopia is Via Djibouti port and no problem at all. UNOPS is the one who facilitate the custom clearance process documents(collect documents from the consignee and submit to the bidders agent) though the consignee is Ministry of Water and Energy.Winner Bidder/Bidders will make a contract with UNOPS and do not neeed to worry the payment will stuck somewhere as long as the required equipment supplied to our partner. All the payment will be paid by UNOPS not by our consignee. Actually, we didn’t ask the certificate of Confirmity(COC)- If winner bidder(s) provide such certeficate, UNOPS would be happy to have it. But it is clearly stated in the schedule of requirement under Inspections and tests section that UNOPS or its representative shall inspect and/or test any or all items of the goods to confirm their conformity to the contract, prior to dispatch from the manufacturer’s premises. UNOPS only accept air-cooled diesel engine and yes, it is acceptable if the one diesel driven pump set is from a different manufacturer.Please note that it is clearly stated in the schedule of requirement part of the tender(General common specifications for all Submersible Water Pumps) that bidder should submit the cable sizing calculation alongwith datasheet as a document with the tender submission for each of the pumps. Bidders are expected to calculate or determine the cable size using the length data given, the maximum voltage drop of 3% and and the motor rating data which the bidder/manufacturer only has.Please note that UNOPS believe the tender floated period is reasonable to bidders to submit their offer. Considering the reasonable tender floating period, UNOPS extend the bid closing date to 29th July 2022.Best regards,
