New clarification added: Dear colleagues,We would like to inform you about significant barriers to the participation of European manufacturers in the RFQ/2025/60469 (Lot 1) procedure, caused by the inclusion of technical parameters for steel carrier pipes that do not comply with EN 253 and effectively prevent manufacturers operating under the European technical standard from submitting their offers.The tender documentation requires steel pipes of 426×7/560 mm and 530×7/710 mm, whereas such diameters are not produced within the EU market. Steel pipes with diameters 426 mm and 530 mm, particularly in longitudinal-welded execution, are not available in the European Union supply chain and are not manufactured by EU producers.As a result, the artificially elevated technical parameters exclude manufacturers operating under EN 253, contradicting the principles of non-discrimination, competition, and broad market access explicitly defined by UNOPS/UNDP procurement policies, as well as by the relevant Resolutions of the Cabinet of Ministers of Ukraine aimed at ensuring competitive and market-based procurement during the period of martial law.It should also be noted that similar approaches in international procurement have previously been recognized as violations (including precedents of the European Court of Auditors and decisions of national competition authorities in EU Member States regarding unjustified narrowing of technical specifications).In view of the above, we kindly request that the technical requirements be reviewed and aligned with EN 253, allowing equivalents defined by the European standard. This will ensure genuine competition, open access, and compliance with transparent procurement policies, which is particularly important given the involvement of international funding.Furthermore, Ukraine has officially harmonized European standards related to pre-insulated district heating systems and has adopted DSTU EN 253:2009 and other relevant standards governing pipes, fittings, and joints. Accordingly, the regulatory framework of Ukraine prescribes the use of the European system of technical norms.Despite this, the RFQ/2025/60469 Lot 1 requirements rely solely on the outdated national standard DSTU B V.2.5-31:2007, which specifies pipe diameters that are not produced in the EU and therefore eliminate the possibility of participation by international manufacturers operating under EN 253.Additionally, according to Table No. 6 of DSTU EN 10217-2:2019, which is explicitly required by the RFQ for steel carrier pipes, the diameters 530 mm × 7 mm and 426 mm × 7 mm listed in the tender requirements do not exist within this standard. The only compliant options under DSTU EN 10217-2:2019 are: 406.4 mm × 7.1 mm, 508 mm × 7.1 mm.We therefore request approval for the use of standard diameters that comply with EN 253:406.4 × 7.1 / 560 mm,508 × 7.1 / 710 mm,steel grade P235GH.Such adjustments will ensure the participation of European manufacturers, alignment with Ukraine’s current regulatory framework, and adherence to the principles of competitiveness, non-discrimination, and proportionality defined by UNOPS procurement rules and Ukrainian legislation.Answer______________Dear Bidder,Thank you for your interest in this tender!Please note that the steel carrier pipe diameters specified in the RFQ (426×7 / 560 mm and 530×7 / 710 mm) were defined in accordance with the national standard DSTU B V.2.5-31:2007, taking into account the geometric, hydraulic, and spatial constraints of the existing district heating network subject to replacement.The specified diameters ensure:- Full compatibility with the existing heat network infrastructure;- Compliance with approved hydraulic calculations and energy efficiency requirements;- Alignment with Ukrainian regulatory requirements governing the design, installation, and operation of district heating systems.The use of alternative EN 253 standard diameters (e.g. 406.4×7.1 / 560 mm or 508×7.1 / 710 mm) would require a comprehensive system redesign, including revisions to the approved project documentation.
