A BAFO (Best and Final Offer) is an optional step in RFPs when multiple proposals receive identical scores. In such case, eligible bidders can only modify their price, unlike negotiations, which can involve clarifying technical offers and adjusting financial proposals.QUESTION No.308:In document of 3_Major_Works_RFP-2025-56497_Section_VI_Returnable Schedules-Schedule 0.4 Capacity and Experience:1). In order to submit a competitive bid, we sincerely hope we can obtain the Client's approval to extend the bid-submission deadline by one month to July 30th, 2025.ANSWER No.208:The deadline for submissions remains June 30, 2025, until 3:00 p.m. (Sint Maarten time).QUESTION No.209:We are interested in Point Blanche Prison and House of Detention Project in Sint Maarten, Dutch Caribbean. However, owing to the following reasons and challenges, we would like to explore the possibility of extending the bid-submission deadline for three weeks from now:1) This project involves a wide range of aspects which necessitates the need to spend more time in inquiring the cost of materials, comparing the prices from different suppliers and communicating with insurance companies,etc.2) This project is quite complicated in terms of techniques which call for more time to conduct the thorough and careful analysis.3) Contractors need more time to look for suitable JV members and local subcontractors.4) Contractors need more time to ponder a great amount of RFIs and analyze and adjust bidding strategies and documents accordingly.5) This project has a quite high and strict standard on contractor’s bid.We sincerely hope that you as the client could consider this proposal of extending the current bid-submission deadline for three weeks.ANSWER No.209:The deadline for submissions remains June 30, 2025, until 3:00 p.m. (Sint Maarten time).QUESTION No.210:We have encountered similar problems as public projects. The time required for relevant personnel and workers to enter Saint Martin through normal procedures is too long (expected to take at least 6 months), and there are too many departments that need approval, which will definitely affect the construction period. Are there any other exemption procedures for personnel to enter quickly? To avoid delaying the project schedule.ANSWER No.210:The registration in the Country is an obligation of the contractor once awarded. It is our understanding that the process should take between 4 and 6 weeks, even if the practice shows that sometime it lasts longer.Nonetheless, the Contractor will count with the suppport of UNOPS. As part of that, UNOPS has already reached out the Authority requesting "fast track" for the registration and it is confident that a practical solution will be found not to obstruct the contactor getting enabled to operate in the country. The Contractor shall set up is working program and schedule based on the assumption that the permit will be released within a reasonable time.During the award process, the parties will get into the detail and, provided that the Contractor will be able to fully comply with the local requirements to obtain the registration, if needed an extnsion might be granted.

New clarification added: QUESTION No.191:Since this is lump-sum contract, whether the contract price will be adjusted/adjustable in the situations when the design changes or variations occurred? Please kindly conifrm on this aspect. Thanks a lot.ANSWER No.191:Please refer to Clause 13, "Variations and Adjustments," in the General Conditions of the Contract for Major Works.QUESTION No.192:In the document of 3_Major_Works_RFP-2025-56497_Section_VI_ReturnableSchedules-4.9 Insurance Details and Insurances, we think this form is for reference ONLY and not applicable for this bidding stage as all the details (Name of Insurer, Policy No., Insured Amount, Renewal Date, Name of Broker, Contact details of Broker) can't be determined in this stage which is to be finanlized in the execution period, could you kindly confirm on this aspect? This form should be left blank, what we bidders need to submit is the confirmation letter from the insurance company that the insurance company will issue the insurances policies to the successful wining offeror based on the requirment in this solicition document.ANSWER No.192:In accordance with Technical Criterion 2.3 of Section II (Evaluation Method and Criteria), your proposal must demonstrate how the insurance requirements will be fulfilled. This can be done by either proving your existing insurance policies meet the Request for Proposal (RFP) requirements or by submitting a confirmation letter committing to obtain the specified insurances in Schedule 3.10 [Insurance Requirements] if awarded the contract. To demonstrate compliance, please provide the following:1. Completed Schedule 4.9 [Insurance Details and Insurances] detailing your current insurance policy information to confirm adherence to the requirements. Alternatively, if you are providing a confirmation letter, include basic insurance details within this schedule and clearly reference the attached confirmation letter. We advise against submitting a blank schedule.2. A confirmation letter (or draft policy) from an insurer verifying their commitment to issue the required insurance policies as outlined, should you be selected.QUESTION No.193:As this prison project will be constructed in stages, and the prisoners will also be transferred in stages (from existing facilities to newly built facilities). Does this mean that the project can be handed-over section by setcion? And the defects notification period applies to the handed-over sections instead of the completion of the whole project? Please kindly confirm on this aspect.ANSWER No.193:We anticipate substantial completion will be achieved section by section, corresponding to project phases, and the Defects Notification Period (DNP) will be applied according to sub-clause 1.14. Although Schedule 1.1 doesn't yet define specific sections, sub-clause 1.14(b) grants the Engineer the ability to designate parts of the works as additional sections.QUESTION No.194:“Latent Defect” means any defect in the Works attributable to:(a) the design and/or construction of the Works for which the Contractor isresponsible;(b) Plant, Materials or workmanship not being in accordance with the Contract; or(c) failure of the Contractor to comply with any other obligation under theContract, which a reasonable examination by the Employer prior to expiry of the last DNP would not have disclosed, and such defect results in the Works or part of the Works not being able to be used for the purposes for which they are intended by the Employer, causes the full or partial collapse of the Works, and/or threatens the stability or safety of the Works. We found that this latent defect seems to include all the possible defects occurred after the DNP (defects notifictaion period). It seems there is no obvious difference between DNP and latent defect period. Therefore the total warranty period for this project is 12 months plus five years, which equals to six years in total. Please kindly confirm whether our perspective is correct as we didn't observe the difference between those two periods.ANSWER No.194:Yes, your perspective is correct. The total warranty period for this project is indeed six years. This is comprised of: a) Defects Notification Period (DNP): 12 months (for defects discoverable by reasonable examination during this period). b) Latent Defect Period: 5 years (for defects not reasonably discoverable during the DNP, which manifest later and impact the Works' usability, stability, or safety). The contract clearly differentiates between these two periods based on when a defect would reasonably be disclosed. We recall this clause is largely accepted in the industry best practice.QUESTION No.195:Concerning the PV System, does the employer have recommended manufacturers and models for photovoltaic modules and inverters?ANSWER No.195:There are no preferred manufacturers.

New clarification added: QUESTION No.186:Ref. Sub-clause 4.1.h of the General Conditions, we kindly ask that you consider additional wording that the Engineer should state the extent to which the Contractor's Documents are not in accordance with the Contract, to enable the Contractor to produce a compliant revision 1, and to delete the criterion "acceptable", which is subjective. Compliance with all the Contract requirements should suffice.ANSWER No.186:Clear, actionable feedback is crucial for the Contractor to efficiently revise documents. While Sub-Clause 4.1(h) requires the Engineer to state when documents are not acceptable or compliant, implying a need for explanation, we will interpret this to mean the Engineer must provide sufficient detail for the Contractor to understand and correct deficiencies. The term "acceptable" in the Engineer's review means documents must meet contract requirements, align with project objectives and best practices, and be practically implementable, reflecting the Engineer's professional judgment under Sub-Clause 3.1(c). Therefore, the contract conditions will remain unchanged, but the requirement for the Engineer to specify how documents are non-compliant will be understood as needing enough detail for effective correction, ensuring an efficient review and high-quality documents.Contract management will adhere to the highest standards, following best practices of FIDIC alongside UNOPS rules and regulations.QUESTION No.187:Ref. Schedule 3 item 3.5.a, please consider adding the word “Notice”, making it clear that activities will be mentioned in the Commencement Date Notice. Ref. Schedule 3 item 3.5.a, please consider adding the word “Notice”, making it clear that activities will be mentioned in the Commencement Date Notice.ANSWER No.187:Please refer Sub-clause 8.1 Commencement of Work, a). "The Engineer shall give the Contractor no less than seven (7) days notice of the Commencement Date of the Works which shall be within twenty-eight (28) days of the Contract Effective Date."QUESTION No.188:Ref. Sub-clause 1.6 of the General Conditions, allows the client to assign the Contract. We kindly ask that you include wording to the effect that UNOPS would provide a payment guarantee in such a case.ANSWER No.188:Sub-Clause 1.6(a) allows UNOPS to novate, assign, transfer, and/or charge the benefit of the Contract, a standard provision reflecting its operational model as a UN subsidiary. As an intergovernmental organization with reserved privileges and immunities under Sub-Clause 1.24(a) that extend to its financial undertakings, providing a separate payment guarantee upon assignment is not UNOPS' standard practice due to its unique status and robust financial oversight. The Contractor's financial security is addressed through established payment terms, advance payment security (if applicable), and performance security within the existing contractual framework. Therefore, additional wording for a payment guarantee upon contract assignment cannot be included, and the general contract conditions will remain unchanged.QUESTION No.189:Ref. Sub-clause 14.16.a of the General Conditions, we acknowledge the Client's need for such audit and investigation, however if the Contractor is required to finalize all claims for the last two statements, then it would only be fair if the Client makes use of the 31 months leading upto, plus 3 months afterwards [not 2 years] for the last 2 statements, to carry out such audits and investigations. Once demobilized it is very disruptive to remobilize personnel to serve the auditors / investigators and with no means of compensation. We kindly ask that you consider re-wording accordingly.ANSWER No.189:UNOPS' standard two-year post-payment audit period after contract expiration or termination (Sub-Clause 14.16(a)) is necessary for thorough financial accountability and compliance as a UN entity and its obligation to demonstrate prudent use of funds. While a shorter audit window aligned with final statements is preferred, it would significantly limit the effectiveness and scope of necessary post-payment audits. Despite potential inconvenience to the Contractor, robust oversight requires this provision. The Contractor is expected to maintain comprehensive records as per Sub-Clause 20.3(f), which should facilitate any future audit requirements. Therefore, Sub-Clause 14.16(a) will remain unchanged.QUESTION No.190:Ref. Schedule 3 section 3.6, please confirm that there are no Nominated Subcontractors.ANSWER No.190:We confirm that there are no nominated subcontractors.

New clarification added: QUESTION No.181:We understand your response to RFI 27 such that the Contract Drawings included in the Contract Documents, will not be at final issued-for-construction [IFC] state, and that the Contractor would be responsible for the remainder design development to produce IFC drawings. Our understanding of the Contract principles is that it is a Red FIDIC bid-build contract with all design for Permanent Works Owner-provided i.e. limiting any Contractor-provided design to Temporary Works. We have no issue with Permanent Works Drawings not being at IFC state by the Contract Effective Date, as long as the Contract time schedule comprises one or several milestones reflecting IFC due dates. However, we would have difficulties if the design responsibility for Permanent Works, was split between ourselves and the Owner's engineer. We kindly ask that you reconsider your response to RFI 27.ANSWER No.181:This Answer also clarifies Answer No.27 as follows:This Construction Contract is a bid & build type. The Employer is responsible for the Permanent Works design; and he retains the fundamental design liability for the Permanent Works; the Contractor's design responsibility is limited (refSub-Clause 4.1(c)(ii)).The Employer is responsible for the "Issued for Construction (IFC)" drawings. The IFC will include changes (if any) between the current "for Bid" Dossier" and the IFC; the parties shall agree on these changes according to the variations procedure.Variations (if any) might result in addition or deduction (e.g. value engineering).Notwithstanding, the Contractor remain responsible to further develop the IFC into the "Final executive Drawings" (FED). He will develop and submit the shop drawings (and other technical docs might be needed) to enable the Employer approving the constructuion/execution pahse.QUESTION No.182:Sub-clause 1.1 of the General Conditions defines "Cost" as excluding overhead and profit and "Cost Plus Profit" as Cost plus Profit [but no overhead], and Schedule 3 item 3.4.1.1 specifies such Profit as zero. We kindly ask that you consider re-wording to cover non-Project-specific overheads, and especially in cases where such risk also causes EOT, where our deployed resources would be unable to recover overheads during any extended period.ANSWER No.182:As Schedule 3.4 Valuation and Payment, sub-clause No. 1.1 indicates, cost plus profit is not applicable.QUESTION No.183:Ref. Sub-clause 3.5.h of the General Conditions, a determination of the Engineer can potentially be corrected and at such time ceases to be binding. Please clarify how and why an agreement, once reached, can be non-binding anymore.ANSWER No.183:Sub-Clause 3.5(h) states agreements and determinations are binding until corrected under Sub-Clause 3.5 or a determination is revised under Clause 20. Sub-Clause 3.5(i) allows the Engineer to correct typographical, clerical, or arithmetical errors in a determination within seven days of notification. While both are binding, only determinations can be unilaterally "corrected" by the Engineer for these specific errors. Agreements, being mutual, are generally final and require mutual consent to amend or set aside, unless a fundamental issue exists. The "correction" mentioned in Sub-Clause 3.5(h) primarily applies to determinations, as correcting an agreement for minor errors necessitates further mutual agreement, not a unilateral act by the Engineer. Thus, a formal agreement is binding unless mutually changed or fundamentally flawed, while the correction mechanism addresses minor errors in Engineer's determinations.QUESTION No.184:Ref. Schedule 2 item 2.1.c.2 the design included in the RFP documents is referred to as the “Final Executive Design”.However, ref. Schedule 3 item 3.5.a requires the Schedule for Works to include for "the development of the design". Please clarify whether the client-provided design will require further development post Base Date, or whether the design included in the RFP documents, is already issued for construction.Ref. Schedule 2 item 2.1.c.2 the design included in the RFP documents is referred to as the “Final Executive Design”.However, ref. Schedule 3 item 3.5.a requires the Schedule for Works to include for "the development of the design". Please clarify whether the client-provided design will require further development post Base Date, or whether the design included in the RFP documents, is already issued for construction.ANSWER No.184:Please refer as well to Answer to Q#174 aboveThe “Final Executive Design” or the For BiD dossier included in the RFP documents has sufficient details for costing/pricing.Schedule 3 item 3.5.a informs that some further development -such as shop drawings, detailed construction drawings or coordination- are still required. We confirm the contractor is expected to further develop the IFC design before starting construction (i.e. shop drawings) and get approval by the employer/engineer prior to start execution.QUESTION No.185:Ref. Sub-clause 10.1.a line items (i) through (x) of the General Conditions, lists the prerequisites for Taking-Over. Please clarify that line item (x) "a Taking-Over Certificate has been issued" is a prerequisite for Taking-Over.ANSWER No.185:The listing of the Taking-Over Certificate within the prerequisites for Works Completion under Sub-Clause 10.1(a) indicates that its issuance is the formal confirmation by the Engineer that all preceding conditions (i)-(ix) have been met. Therefore, while listed as a prerequisite, the Taking-Over Certificate (x) acts as the formal and culminating act signifying satisfactory completion and official handover to the Employer. Without the certificate, formal Taking Over has not occurred, even if all other conditions are met.

New clarification added: QUESTION No.173:Sub-clause 14.12 of the General Conditions provides that, should the Contractor fail to provide such discharge, the latter shall be deemed submitted. We kindly ask that you consider re-wording such that the discharge be a prerequisite for the final payment.ANSWER No.173:We acknowledge your preference for the discharge to be a prerequisite for final payment under Sub-Clause 14.12. However, the current wording, which considers the discharge submitted if the Contractor fails to provide it, is important for ensuring timely financial closure, even with unresolved issues. This prevents indefinite delays to final payment, which could cause significant problems for the Employer. While the discharge signifies payment finality, Clause 14.12 (d) allows the Contractor to still pursue legitimate disputed amounts via Clause 21 (Dispute Resolution). Therefore, the existing contract conditions regarding Sub-Clause 14.12 will remain unchanged.QUESTION No.174:Sub-clause 14.14 of the General Conditions constitutes a claim waiver to the client's benefit, except for amounts which the Contractor has expressly mentioned in the statement at Taking-Over as well as in the final statement and which the Engineer has certified. This prohibits the Contactor from the Dispute Resolution procedure for any amount the Engineer disagrees with, hence we kindly ask that you consider re-wording.ANSWER No.174:Sub-Clause 14.14 establishes the Employer's final liability based on the Contractor's payment requests within the contract. It requires the Contractor to present all potential claims in the Statement at Taking Over and Final Statement for the Engineer's assessment. However, this clause does not prevent the Contractor from pursuing dispute resolution under Clause 21. The Sub-Clause 14.12 (d) of the Contract allows continued dispute resolution for ongoing proceedings. Sub-Clause 14.14 aims to prevent new claims after the final payment certificate if they weren't previously presented, ensuring systematic financial closure while preserving dispute resolution for properly submitted, unresolved claims. The general contract conditions remain unchanged.QUESTION No.175:Considering the unique nature of the prison, is there any special requirement for the security system, especially for the software/system compatibility or any special requirements for designated/nominated subcontractors to undertake the security system works?ANSWER No.175:Please refer to SXM-ZZZ-SE-REP-701 for requirements on the security system.QUESTION No.176:In the document of "3_Major_Works_RFP-2025-56497_Section_VI_ReturnableSchedules"-4.8 Sources of Naturally Occurring Materials-(Details of any pre-identified sources of construction materials such as borrow pits, quarry sites, water sources, sand sources and likewise), based on our knowledge and actual investigation, there is almost none construction materials are categorized as naturally occurring materials and almost all the materials in the island are imported from abroad. Therefore, whether this form-4.8 Sources of Naturally Occurring Materials is not applicable and can be deleted/ignored. Could you kindly confirm on this aspect?ANSWER No.176:Regarding Schedule 4.8 'Sources of Naturally Occurring Materials,' this form remains applicable for your proposal submission.Even if construction materials are primarily imported, they are still derived from natural sources. This schedule is intended to capture information about the origin of such materials, whether local or international, to ensure a complete understanding of your proposed sourcing.QUESTION No.177:Concerning the PV Sysetm, could the client provide and confirm the power and external dimensions of individual photovoltaic modules?ANSWER No.177:Please refer to section 10 of CALCULATION TECHNICAL ELECTRICAL REPORT (Doc. No. SXM-ZZZ-EL-REP-702),and to SXM-ZZZ-EL-REP-701 - ELECTRICAL SYSTEM DESCRIPTIVE REPORTQUESTION No.178:Concerning the PV system, according to the BOQ, there are two 15kW inverters on the AC side of the photovoltaic system, with a power generation installed capacity of 30KW. What is the installed capacity on the DC side?ANSWER No.178:Refer to section 10 of CALCULATION TECHNICAL ELECTRICAL REPORT (Doc. No. SXM-ZZZ-EL-REP-702)QUESTION No.179:Concerning the PV System, according to the BOQ , the number of photovoltaic modules is 120, and the installed capacity on the DC side should not exceed 40KW. Therefore, the power of a single module should not exceed 350Wp. Small power modules are currently difficult to buy on the market. Can we choose high-power modules ranging from 500 to 650Wp? If we use high-power modules, then the number of modules will be less than 120, could you kindly clarify on this aspect?ANSWER No.179:Refer toSXM-ZZZ-EL-REP-701 - ELECTRICAL SYSTEM DESCRIPTIVE REPORTSXM-ZZZ-EL-REP-702 - ELECTRICAL CALCULATION REPORTSXM-ZZZ-EL-REP-703_Electrical Technical SpecificationsQUESTION No.180:In the document of 3_Major_Works_RFP-2025-56497_Section_VI_Returnable Schedules-0.1 Proposal Submission Declaration, we found that it looks similar like Letter of Bid, but there is no requirement for Offerors to fill in the bid price for this project? Could you kindly confirm on this aspect? ANSWER No.180:Due to this tender being a RFP (two envelope methodology), Schedule 0.1 is part of the Technical Offer/envelope and must not contain any price information. As per the instructions, all schedules must be completed as indicated without alteration. Price information is strictly reserved for the Financial envelope documents/schedules. New clarification added: QUESTION No.168:We kindly ask that you consider waiving the requirement under Sub-clause 4.2.g/i/j of the General Conditions [parent company guarantee + associated legal opinion + financial reporting]. We think that the amount of Performance Security and retention money combined with remedies under the Contract, provides the Client with ample assurance that the Contractor will fulfil its obligations under the Contract.ANSWER No.168:The general contract conditions remain unchanged. The Bidder is reminded that UNOPS, at its sole discretion and depending on the identified risk level, may request the Contractor to provide a parent company guarantee. This could include a legal opinion regarding the guarantor's obligations under the parent company guarantee and any other financial or other information UNOPS deems necessary to verify the parent company's suitability, in accordance with sub-clause 4.2, literals g), i), and j).QUESTION No.169:Ref. Sub-clause 4.2.k of the General Conditions, please confirm that the reference determination is a determination given by the Engineer and not any determination under the dispute resolution procedure.ANSWER No.169:Sub-Clause 4.2(k) requires the Performance Security to remain valid until the Final Completion Certificate is issued and site clearance is complete, or, if a dispute arises, until its final determination, whichever is later. "Final determination" includes both Engineer's determinations becoming final and binding and resolutions reached through formal dispute resolution under Clause 21, such as arbitration awards. Therefore, the Performance Security must remain valid throughout any dispute resolution process, ensuring continuous security for the Employer during claims and disputes.QUESTION No.170:The bid validity period is 3 months, plus 1 month between Effective Date and Commencement Date, plus 31 months' Time for Completion. This is almost three years [not counting potential prolongation of the bid validity period with no specified limit]. Hence, we kindly ask that you consider including either a substantial inflation contingency, pricing or preferably, an escalation model [Sub-clause 13.7 of the General Conditions]. Such an adjustment could reflect costs only, excluding overhead and profit.ANSWER No.170:The initial requirement is maintained. No adjustments will be made for fluctuations in the cost of labor, Goods, or other Works inputs over the project's lifecycle. Bidders are responsible for including all necessary mitigation measures in their financial proposals.QUESTION No.171:Sub-clause 14.10.c of the General Conditions comprises a waiver for all Claims where the underlying events or circumstances dates are earlier than the Statement at Taking-Over or 28 days after the date that the Taking-Over Certificate was issued. Sub-clause 14.10.a of the General Conditions obliges the Contractor to include all such Claims in the Statement at Taking-Over, following which the engineer will issue a payment certificate as per Sub-clauses 14.10.b and 14.6 of the General Conditions, which means such amount as the Engineer determines. Hence, the Sub-clause 14.10.c waiver would also include disputed amounts, which the Engineer has not determined and certified, therefore denying the Contractor the Dispute Resolution procedure for such amounts. We kindly ask that you consider re-wording.ANSWER No.171:The intention of Sub-Clause 14.10 (c) is to ensure the timely submission of all claims by the Contractor relating to events or circumstances that have occurred up to the date of the Taking-Over Certificate, thus providing a defined cut-off for the initiation of such claims. It is not intended to deny the Contractor the right to pursue a Dispute Resolution procedure for amounts properly claimed in the Statement at Taking Over but which the Engineer subsequently does not agree to certify in full.QUESTION No.172:Ref. the discharge form required for the final statement [Schedule 5 form 5.3], which includes a waiver to the effect that the Contractor has submitted all claims, and we agree. However, it also requires the Contractor to release the Client from all Claims and such discharge becomes effective upon full payment of the amount certified in the Final Payment Certificate. This means the Contractor would waive any disputed amount included in its final statement [amounts the Engineer has not determined and certified], denying the Contractor the Dispute Resolution procedure for such amounts. We kindly ask that you consider re-wording.ANSWER No.172:The purpose of the discharge form is to confirm the finality of the agreed and certified payments and to close out the financial aspects of the contract once all undisputed amounts have been settled. It is not designed to override the Contractor's fundamental right to invoke the dispute resolution procedures under Clause 21 for legitimate disagreements that could not be resolved by the Engineer (please refer to clause 14.12 (d)).

As the technical proposal & financial proposal is 60% VS 40%, how will the previously successfully prequalified bidders be evaluated and scored?ANSWER No.79:The technical evaluation process consists in three stages 1. FORMAL AND ELIGIBILITY CRITERIA, 2. QUALIFICATION CRITERIA and 3. TECHNICAL CRITERIA. The first two stages are evaluated on a Pass/Fail basis, only Stage 3 is score based. For Stage 2. QUALIFICATION CRITERIA, prequalified offerors are only required to submit proof of their prequalification status in lieu of the full qualification documentation outlined in that Section of the RFP. Therefore, while prequalified offerors are exempt from submitting the full documentation for Stage 2 (QUALIFICATION CRITERIA), they are still required to submit all necessary documentation for evaluation under Stage 1 (FORMAL AND ELIGIBILITY CRITERIA) and will be fully evaluated and scored on their submission for Stage 3 (TECHNICAL CRITERIA)

Despite that; in the sheet SXM-W01-AR-DRA-857, bathroom fixtures are not described as vandal resistant. Since specifications are prior to drawings, we assume that all bathrom fixtures in inmate cells to be vandal resistant. Please confirm.Paragraph 3.19.2.2.c: "Toilets in inmate bathrooms shall be floor-mounted, vandal-resistant units made from stainless steel or other durable materials."Paragraph 3.19.2.2.d: "Sinks in inmate bathrooms should be stainless steel wall-mounted models, as indicated in project drawings. These sinks must be designed to resist vandalism and feature integrated, tamper-proof faucets with anti-splash designs."Paragraph 3.19.2.2.d: "The shower faucets in inmate bathrooms must be made of heavy-duty materials such as brass or stainless steel to withstand frequent use and potential vandalism."ANSWER No.57:Yes, all bathroom fixtures in inmate cells are to be vandal-resistant, in accordance with the requirements outlined in paragraph 3.19.2.2 of the Architectural Technical Specifications.QUESTION No.58:We kindly request access to the "technical access" documents of RFP/202/56497 Construction of the Point Blanche Prison and House of Detention in Sint Maarten, Dutch Caribbean.ANSWER No.58:Please refer to UNOPS CLARIFICATION No.1. Access to the technical documentation requires strict adherence to the instructions provided on the eSourcing platform. Specifically, go to the 'TENDER INFORMATION' tab, select 'TENDER PARTICULARS,' and consult the 'Additional Information' clause for detailed access guidance.QUESTION No.59:In the RFP document-Major_Works_RFP-2025-56497_Section_II_III_IV_V_Amendment1, it stipulates that in 2. QUALIFICATION CRITERIA-"Minimum of 8 turnkey projects at least 75% completed in the last 15 years as General Contractor. Each project must have a minimum construction area of 8,000 m2 of vertical infrastructure. The Bidder must provide the corresponding support documents: Signed contract and certification of completion of each of the contracts emitted by the Client or Funding Source." However, it also stipulates that in 3. TECHNICAL CRITERIA -"For each experience of construction contracts for buildings (vertical infrastructure) of more than 10,000 m² finalized at least 75% completed within the last fifteen (15) years, one (1) point will be awarded up to a maximum of eight (8) points." Could you kindly verify whether it is 8,000 m2 for each project or 10,000 m² for each project? Also, whether the quantity for projects can be less than 8, but the total construction area for the total projects is bigger than 8*8000M2 or 8*10000M2 is qualified and can obtain/get the full 8 points? For example, within the last 15 years, the contractor only has 3 vertical infrastructure projects but the total construction area is 200000M2 which is much bigger than the required construction area. Whether in this case, the contractor can be qualified and get the 8 points? Looking for the kind response in this regard. Thanks a lot.ANSWER No.59:To clarify, please note that the qualification and technical criteria serve distinct purposes in the evaluation process:Qualification Criteria: As stated in the document, the Qualification Criteria (specifically point 2) require a minimum of eight (8) turnkey projects at least 75% completed in the last 15 years as General Contractor. Each of these eight (8) projects must have a minimum construction area of 8,000 m² of vertical infrastructure. These criteria are used to determine the eligibility of a bidder to proceed to the technical evaluation stage. Meeting these criteria is mandatory to be considered for further evaluation.Technical Criteria: The Technical Criteria (specifically point 3) are used to score the proposals based on the bidder's experience.Under the Technical Criteria, one (1) point will be awarded for each experience of construction contracts for buildings (vertical infrastructure) of more than 10,000 m², finalized at least 75% completed within the last fifteen (15) years, up to a maximum of eight (8) points.Addressing your specific questions:Regarding the area: It is crucial to understand that the Qualification Criteria require 8,000 m² per project, while the Technical Criteria award points for projects exceeding 10,000 m². These are separate requirements for different evaluation stages.Regarding the number of projects and total area:For Qualification, the bidder must demonstrate a minimum of eight (8) projects, each meeting the 8,000 m² requirement. Having a smaller number of projects, even with a very large total area, will not meet the Qualification Criteria. Therefore, in your example of three projects totaling 200,000 m², the bidder would not qualify. For Technical Scoring, only projects exceeding 10,000 m² are awarded points. The total area is not a factor in the Technical Criteria scoring; points are awarded per qualifying project (up to a maximum of 8 points). In summary, the 8,000 m² requirement is a pass/fail threshold for Qualification, while the 10,000 m² requirement is a scoring mechanism for the Technical Evaluation.

New clarification added: QUESTION No.26:Please advise how many working days to be considered in the "Schedule of Works" for the PMT to Mobilize/Move-In to the newly built North Building and South Wards after the Construction Stage 1 is completed; considering that the Contractor will not be able to work during this mobilization period, as the Construction Stage 1 is complete and Demolition of Existing Building can not be started.ANSWER No.26:A reasonable duration should be allocated in the Schedule of Works to allow the PMT to mobilize and move into the North Building and South Wards after completion of Construction Stage 1. This period—during which the Contractor will remain inactive and demolition activities cannot begin—should be confirmed in coordination with the PMT during the early planning phase to ensure alignment with operational requirements.QUESTION No.27:Considering the fact that current design and drawings provided by Employer are not IFC (Issued for Construction) but FED (Final Execution Design); please confirm if the cost & duration to be committed for Final Executive Design to IFC development shall be considered in proposal.ANSWER No.27:The process of developing Issued for Construction (IFC) drawings falls under the Contractor's scope of work. Consequently, the Contractor's proposal must incorporate the costs and the time required to produce these IFC drawings.QUESTION No.28:As per "Section IV: Schedule of Details, c.5. The Engineer facilities" (page 41/102); the Contractor shall provide Engineer Facility during construction period. Please advise where the Engineer Facility is required to be established. Should it be located within the construction boundry? Or, is it possible to establish the facility to some other location, such as across the road of the site?ANSWER No.28:While the documents indicate the Engineer's office should be part of the Contractor's site facility and close to the construction site, it doesn't prohibit locating it across the road. The key is that the Engineer's facilities must be functionally integrated with the Contractor's site setup to allow for effective supervision and coordination.QUESTION No.29:Under the Section IV: Schedule of Details (page 48 of 102), it is mentioned that "At least two (2) closed perimeters of security must be in place at all times during the different construction stages. "Please confirm if the Existing Security Wall 4.5m shall be considered as one (1) closed perimeter of security, so that only one (1) other temporary perimeter of security would be sufficient to correspond to the abovementioned requirement. Also please advise whether one (1) closed perimeters of security shall be sufficient to provide "Inmate Flow" after Construction Stage 1 is finished, between the corridor of new main building & new wards and the the area of Contruction 2.1. and Construction 2.2.ANSWER No.29:Yes, the existing 4.5m security wall can be considered as one perimeter of security, provided it meets the requirements outlined in the Site Security Plan. Section 4.8. If the existing wall meets these criteria, it can be considered one perimeter.Regarding inmate flow, one closed perimeter of security may be sufficient, but this requires careful planning and approval. The same document emphasizes the need to eliminate visibility and contact between the construction site and prison operations. While a single perimeter might achieve this, the Contractor must detail how it will ensure security and controlled inmate flow in their Site Establishment Plan and Traffic Management Plan. Ultimately, UNOPS and the Prison Management Team retain the authority to review and approve the Contractor's proposed solution, considering the specifics of each construction stage and the proposed mitigation measures.QUESTION No.30:Could you please share the contact information of the owners of the plots available for rent across the road?ANSWER No.30:The contact information of the plot owners across the road will be shared exclusively with the awarded offeror.QUESTION No.31:Kindly advise the exact Location and characteristic information (dimension, depth, material etc.) of the existing septic tank to be demolished. In case the demolish of the existing septic tank coincides with the Construction Phase 1 structures, please clarify which party will be responsible for temporary septic tank and its connections to the existing facility.ANSWER No.31:The exact location of the existing septic tank to be demolished can be found in the SXM-ZZZ-SA-DRA-101.The Contractor is responsible for providing a temporary septic tank and its connections to the existing facility. This responsibility falls under the Contractor's obligation to maintain site services during construction. Please refer to SXM-ZZZ-SA-REP-703_Technical Specifications.QUESTION No.32:The Bidder kindly requests the specification related to "Textured Concrete" which is specified in the Wall Types of C04, C05, C07ANSWER No.32:Please refer to the Architectural specifications for descriptions regarding formwork (p.19) to be used in order to create the vertical rippled effect wherever textured concrete is indicated in the drawings.QUESTION No.33:Dear Procurment Officer, which party will be responsible for the security for the prisoners during the whole construction period as the prisoners will be transferred to the new facilities in phases? The Employer or the Contractor?ANSWER No.33:The security of the prisoners throughout the construction period will be entirely and solely managed by the Prison Management. The Contractor’s role will be limited to ensuring clear and unobstructed spaces and access routes, and to refraining from work in specific areas as agreed in advance by all parties.QUESTION No.34:Dear Procurement Officer, as this is the public works of government, whether both the work permit and residence permit can be waived/exempted by the government of st maarten? As these costs will be added into the bid price and acturally borne by the Employer and the process for getting done those two permits for the workers will take a comparatively long period which will affect the construction period.ANSWER No.34:Offerors are required to comply with all legal procedures related to obtaining work and residence permits in Sint Maarten.
