New clarification added: Question 5: "Award decision shall be based on the Lowest priced most technically acceptable offer."Please clarify the meaning of "Award decision shall be based on the lowest priced most technically acceptable offer." What does "most technically acceptable offer" mean? As already indicated previously, our company submitted a bid for very similar equipment and location under RFQ/2022/41942. Our FNAC bid was 100% in complaince with ALL RFQ specifications in that tender. Further, our FNAC bid was in 100% compliance with ALL RFQ terms and conditions. Further, our FNAC bid supplied ALL required RFQ documents in full compliance with ALL RFQ specifications, terms and conditions. Yet, RFQ/2022/41942 was awarded to a local company in Yemen covering all 7 Lots at prices nearly 100% higher than the FNAC fully compliant and technically acceptable submitted bid. Several requests to UNOPS were made requesting to know the reasoning behind the award to the local Yemen company, and there was no response. So we ask again, what does "lowest priced most technically acceptable offer" mean? If "technically acceptable" means a preference towards the brand being offered by the same local Yemen company, please state so enabling us to withdraw from making an offer covering this specific tender.Thank you for your attention.Answer: Please note that UNOPS provides debrief unsuccessful bidders upon receipt of a written request and the request for debrief must have been received from you within 10 calendar days of the notification by UNOPS of the tender results. All unsuccessful bidders who requested for the debrief under the tender you're referring to were duly informed on the reason as to why they were not successful. Raising the question under a new tender does not suffice. In addition, please send your request for debrief to the related award results/RFQ notification results.

New clarification added: Question 4: In reference to your answer related to another vendor's inquiry: "Answer: Please note that the after-sale service provider should be the contractor and must have a physical presence in the contract/project territory"This does not promote any "open" competition as previously stated. This limits the quantity of eligible bidders, as the answer practically eliminates and restrain all international bidders from participating. As the other vendor, we also have established partners situated in Yemen that can conduct the requested after sales service, while we as a bidder do not have any physcial presence in terms of an office or alike our selves. Kindly clarify whether this tender is only eligible for local bidders?Answer: Please refer back to RFQ-Criteria where its mentioned the following:“International suppliers shall have a local representative, agent, and/or physical presence in Yemen.”

New clarification added: Question 3: I am writing to inquire about the after-sales service requirement stated in the RFQ RFQ/2023/45101. Our company is based in the UAE and we would like to confirm that if the project is awarded to us, we will subsequently arrange for a partner in Yemen to conduct after-sales services after the end of the warranty period.Can you please confirm if this arrangement is acceptable and if there are any other specific requirements or expectations that we should be aware of in regard to the after-sales service?Answer: Please note that the after-sale service provider should be the contractor and must have a physical presence in the contract/project territory

New clarification added: Question 1: We the greatest of respect we ask the following question: The last RFQ/2022/41942 covering very similar equipment was awarded to Bin Fatsha & Brothers Contracting Company Ltd. Yemen. The award was given covering all 7 Lots to this same company at prices double from our company's fully responsive submitted bid, and double the prices of the current international market. When we requested UNOPS for an explanation, we were ignored with no response. We respectfully request from UNOPS to please advise if UNOPS has intentions to proceed to order the equipment under the current tender to the same Yemen company so that we as bidders do not waste any time on the current tender.Answer: Please note that this is a new open competitive tender in which all qualified bidders can participate. The evaluation method is: Bids shall be evaluated as specified in the document titled Section I: Instructions to Bidders, and following evaluation criteria included in the Evaluation Criteria section.Award decision shall be based on the Lowest priced most technically acceptable offer.
