Description

1. BACKGROUND

The global health system has changed over the years and it has resulted in changes in the clinical practice guidelines and health workforce competency standards. This has also introduced an opening to new risks due to outdated or non-existent legislation. Hence, improving and strengthening of the legal framework governing overall practice and competency of healthcare workers has become more important.

The Marshall Islands Ministry of Health and Human Services, Public Service Commission and Ministry of Justice have partnered with the World Health Organization (WHO) and Pacific Open Learning Health Net (POLHN), to draft the necessary Bills to govern the current health related practices and competencies in the Republic.

 

2. PURPOSE/SPECIFIC OBJECTIVE OF THE ACTIVITY

Working closely with the WHO Division of Pacific Technical Support (DPS), Republic of Marshall Islands Ministry of Health and Human Services, Public Service Commission and Ministry of Justice, the consultant will conduct thorough research diagnostic and develop country-specific national Medical Practice Bills in-line with the country’s Constitution and prepare necessary documents for submission to the Cabinet for the approval of the Bills.

 

3. DESCRIPTION OF ACTIVITIES TO BE CARRIED OUT

In collaboration with the WHO Pacific Health Systems and Policy team, Republic of Marshall Islands Ministry of Health and Human Services, Public Service Commission and Ministry of Justice, the consultant will produce the following:

  1. an agreed work plan with timelines;
  2. diagnostic and report on the health practice framework including legislative review and report on consultation with stakeholders;
  3. draft Medical Practice Bill, detailed Explanatory Memorandum and Cabinet Submission and
  4. draft subsidiary legislations to govern the processes within the Act.

 

4. METHODS TO CARRY OUT THE ACTIVITY

The Consultant will:

  • conduct a desk top review of the existing legislative framework;
  • carry out a full diagnostic of the current medical practice including a legislative review and report on the same;
  • conduct in country consultations on the proposed legislation;
  • draft Bill;
  • prepare detailed explanatory memoranda for the new Bills;
  • draft the Cabinet submissions appending the new Bills;
  • provide upon request briefings on the proposed Bills; and
  • draft and submit a final report encompassing these terms of reference.

 

5. QUALIFICATIONS & EXPERIENCE

 

EDUCATION

  • Essential:  Bachelor of Laws degree is essential;
  • Desirable: Post Graduate Degree in Law is desirable.

 

EXPERIENCE

 

Essential: At least 5 years of work experience with a specialisation in legislation drafting; 

  • Knowledge of the international and regional medicolegal framework;
  • Experience working in Pacific island jurisdictions; and
  • Health related experience will be an asset.

 

TECHNICAL SKILLS & KNOWLEDGE

 

LANGUAGES

  • Written and spoken fluency in English is essential. Working knowledge of other UN languages is an advantage.

 

COMPETENCIES

  • Excellent oral and written communication skills;
  • Ability to meet tight deadlines and produce succinct reports;
  • Producing results as measurable by specific outputs;
