Draft National Hospital and Medicines Bills for the Republic of Nauru (RE-ADVERTISEMENT)

Background

The global health system has changed over the years and it has resulted in changes in the clinical practice guidelines and health workforce competency standards. This has also introduced an opening to new risks due to outdated or non-existent legislation. Hence, improving and strengthening of the legal framework governing overall practice and competency of healthcare workers has become more important.

The Republic of Nauru’s Department of Health and Medical Services and Department of Justice and Border Control have partnered with the World Health Organization (WHO) and Pacific Open Learning Health Net (POLHN), to draft the necessary Bills to govern the current health related practices and competencies in the Republic.

Purpose of the contract

Working closely with the WHO Division of Pacific Technical Support (DPS), Department of Health Medical Services and Department of Justice and Border Control, the consultant will conduct thorough research diagnostic and develop country-specific national Hospital and Medicines Bills in-line with the country’s Constitution and will prepare necessary documents for submission to the Cabinet for the approval of the Bills.

Method(s) to carry out the activity

The Consultant will:

• conduct a desk top review of the existing legislative framework;
• carry out a full diagnostic of the current health/hospital environment including a legislative review and report on the same;
• conduct in country consultations on the proposed legislation;
• draft the 2 Bills;
• prepare detailed explanatory memoranda for the new Bills;
• draft the Cabinet submissions appending the new Bills;
• provide upon request briefings on the proposed Bills; and
• draft and submit a final report encompassing these terms of reference.

   

Outputs

In collaboration with the WHO Pacific Health Systems and Policy team, Department of Health and Medical Services and Department of Justice and Border Control, the consultant will produce the following:

1. an agreed work plan with timelines;
2. diagnostic and report on the health/medicines framework including legislative review and report on consultation with stakeholders;
3. draft National Hospital Bill, detailed Explanatory Memorandum and Cabinet Submission;
4. draft Medicines Bill, detailed Explanatory Memorandum and
   Cabinet Submission.

Deliverable(s) to be submitted during and after the period of the assignment including manner of delivery and payment

• 0% upon signature of the contract
• Draft Act in-line with current constitution;
  (TBD)  (40% payment)
• Final report with  first revision for the Cabinet;
  (TBD) (60% payment)

Qualifications and Experience

Qualifications required:          

• Master of Laws, Medicolegal, Ethics, International relations or related field
• Post Graduate Degree in Law is essential;

Experience required:

• At least 5 years of work experience with a specialisation in legislation drafting; 
• Knowledge of the international and regional medicolegal framework;
• Experience working in Pacific island jurisdictions; and
• Health related experience will be an asset.

Language requirements:

• Written and spoken fluency in English is essential. Working knowledge of other UN languages is an advantage.

• Excellent oral and written communication skills;
• Ability to meet tight deadlines and produce succinct reports;

• Producing results as measurable by specific outputs;
